I would like to know from our esteemed members in this group or other group ...
In our society we have DG back up and charge the residents for the DG power supplied to them based on the cost of diesel consumed and repair cost. Now the Maintenance company is charging GST on DG power supply.

Can some one please let me know what are the rules or guidelines in such cases when the DG rates fixed is just to recover the actual cost of diesel and preventive maint if any. more

What exactly the agency doing? Maintenance of the DG set or operating the DG set (filling the diesel, starting stopping the set etc.). Depending on type of service you have contracted with him. GST will be payable only on the service amount charged .If service does not include fuel charges (fuel supplied by society), then fuel charges will not come under services and no GST on that part. Off course, service provider should be registered in GTS for any service then only they can charge GST from you. more

Dear Brij Gupta. If your query is on GST my answer is as follows. Charging GST by service provider is in order,provided he is a GST registered Person. If your query is on the Agreement with Service Provider,entered prior to GST then my answer is as follows. If the agreement with the agency specifically metnion that the payment is for the actual consumption of diesel plus actual expenses towards maintanance and NO taxes are payable by you,then NO GST is payable by you.For this you need to verify the Bill paid during the period prior to GST and ensure that there is NO tax part/Service Tax collected more  
If the Society has entered into a contract with a Firm to ensure proper operation and maintainance of DG set, GST on the periodical payment to the Firm should be applicable. Perhaps Diesel Oils could be billed as per actual. However, it is suggested to consult a GST Tax expert on the issue. more  
Get Rs.1 Credit worth credit card from the bank in name of your society. Link the card with the bank account in the name of society (Keep loading this credit card from bank account as per need basis). Handover this card to maintenance guy to buy the diesel. Hence, diesel will be always procured by the society without money transfer to(via) maintenance guy(company). Now, you have to pay GST only to the service charge to maintenance guy(company) more
