Developer did not allot flat facing park as promised while booking.So the allotment was cancelled by me within 5 days after receiving email about allotment.Developer refused to refund booking advance of INR 9 Lakhs on plea that I was suppose to cancel in 72 hours only.I am NRI living in Dubai.I s

Lawfully Debt Recovery Agents are for recovery of debts/loans, but your money is not a loan but an advance to the builder . The best legal way is to move consumer court but you can take the help of these agents as short cut approach. But first decide the terms & condition in writing about the fee of recovery agents. Then hand over the case. Mind the time limit should be not more than 6 months. more

Legally, they are right. However, you should pressurise ur agent in India and also ask the developer to extend the goodwill and at least transfer this advance to any other scheme. Another alternative is to go ahead with purchase and dispose it in resale. more

I had argued with them that how come you have refunded for one cancellation and refusing to refund for second one.Their answer was that out of good will they have refunded. more
