Service Tax has to be charged by you from Recipient of services and deposited with Govt. Income Tax to be paid on taxable income after deducting expenses incurred to earn that income. more

Sure , we will request this. But they r nt providing ST and hence r not affected. They knw this law is of India and hence onus is on us to find wherewithals to circumvent it. more

In fact your overseas buyers or sellers can request their governments to challenge this provision in WTO as this provision violated WTO agreements. more

As per finance bill introduced by PC, the then FM, ST was imposed on service takers who cud take credit for the same. Just like TDS. Although, onus of collecting and depositing the same was on service provider. Gvn abv, our buyers and sellers are outside India and hence not bound by Indian laws. It is impossible, for us to collect ST fm them. So levying ST on us seems travesty of law and well laid down principles of economics. If someone is intersted to file PIL we are ready to support with all required dox. more

service tax paid on commission received from overseas buyers is a very debateable point. At the moment, you pay the service tax on such income and I feel it cannot be claimed as a refund. In my opinion constitutional validity of this provision shall be challenged sooner or latter. more
