Can any esteemed practicing legal member share any S.C. order favoring Landlord in property dispute matter please? I am suffering for 9 years while my tenant enjoys possession of my flat and has been paying rent in court at the same old rate when he undertook 11 month agreement. Please Help. more

Sir, the tenant filed a case pleading with court not to be dispossessed admitting he was tenant and thereafter for almost 4 years he or his lawyer never appeared and out own lawyers after a few dates did not put in appearance as we are in Delhi and had trusted our lawyers. I myself personally appeared before the FCJM almost 1.5 years and questioned him why the court is lenient with tenant who is a local whereas I take the pains of commuting from Delhi for every hearing. Then my lawyer came with a proposal that the Judge wants 10% of market value of flat to pass order in my favor and I did not believe this could happen and asked him to fight the case on merit. Next hearing this judge passed an Order asking status quo to be maintained till final disposal of case - totally favoring tenant. I have changed 4 lawyers and many currently non practicing advocates who have become Notaries now sacrificing their career for family have said this is the current corrupt trend in most courts in Gujarat that lawyers when they know client is outsider, either gang up with opposition to take the court and client for a ride to milk as much from them as they can. Unfortunate as it is, the reason I asked for the Supreme Court judgement was to try and present the case that even SC has been aware and come down on such practice of tenant trying to take Law to suit his greed by circumventing it to his favor. more

There are N' Number of SC & HC verdicts to the effect. Only you have to follo the Proper procedure of Eviction Case. Unable to understand what you are going to do with any specific SC / HC verdict - which may not be suitable to your matter - Only 11 moth's leave and license case will not suffice the very purpose BUT other details as well. It seems you had already in the Court matter wherein the Tenant is depositing the Rent in the Court. Pl. gear up for the reason why the matter is pending for such a long period. It seems your Pleader is NOT taking the due steps in time, else you can also approach to the High Court under Writ Petition as well. more
