GST on Under Construction home

Hello Friends, I am buying my first home in Pune which is under construction. Builder is charging 12% GST on Agreement Value. I am eligible for 8%GST as per CLSS scheme for MIG-2 category. Can I ask builder to revised cost sheet as he is insisting to complete Registration asap? What if builder does not agree to charge GST at 8%? Please assist as it seems like no one has clarity on this rule. more

The matter regarding "affordable housing" Can be got clarified from the 'Town and Country Planning department.. more

We have a GST number for our one year old firm. As there was no business transaction, we did not remit any GST. We are now told that there is a penalty for not sending a nil form- sounds pretty vague when we did not send a return as there were no transactions. NOW WE HAVE RECEIVED A NOTICE FROM THE GOVT. MENTIONING THAT OUR GST LICENSE WILL BE CANCELLED in December. We are totally confused by these rules as we actually hope to get orders soon and will need a GST number which was already furnished to our bank and other authorities. Any advice will be welcome. Job Xavier ji, GST Act and Rules Require you to file the Monthly Returns in form 3B even if you have no business. Hence, the notice issued by the Govt.hold good correct in respect of late filing levies / fees. But, in Nil return Cases, late filing fees are very less compared to with Transaction cases. more  
No one can get away charging higher percentage of GST. Get your clarification properly from an authorised GST consultant. more  
Sir, you are eligible for concessional GDT of 8% only if the project in which you are buying is declared "affordable housing" by the government. If it hasn't been declared as such then GST of12% is leviable. more
