I have an ancestral house in Old Delhi which belonged to my grandfather and was occupied by tenants since 1947. As my grandfather & father passed away I inherited this property & was collecting rent. In 1998 I learnt that the tenants handed over my property to local goondas who then made 4 storied building. these anti social persons made false property papers & registered sales to various people who are now occupying my property. I approached MCD who were of no help but increased the house tax based on this extra construction. With High Court's intervention I could get a criminal complaint filed with Delhi Police and the case has been dragging along in Tis Hazari. Is there any legal way I can get the fake sale deeds cancelled and also get my premises vacated / demolished. Please advise. more

strike off increased house tax may not be possible unless it is demolished. 3years limitation period only for debt. hence it may not be applicable here.you can always appeal for condone delay giving valid reasons. more

Thanks everybody for your good advice. 1.Is it possible I can seek court intervention to get MCD to strike off the increased House Tax levied on the unauthorized construction (which was done by occupants without my permission) and also demolish this unauthorized construction. 2. Is it possible to file suit for physical possession even after the limitation period of 3 years is over. more
