Effective remedy against the hegemony of advocates is that maximum persons argue their own cases before the courts. It will be faster, close to the facts, and less complicated. If lawyers are starved of funds they will lower their rates and behave as service at reasonable fees. more

The reason why cases are piling up is that the first line of justice is weak.We do not get justice at the first level and so we appeal to the higher court.The Orders of the lower courts are sometimes so absurd that it makes on angry. Why should I be held guilty if as scooter driver hits my back bumper and falls down sustaining a head injury? Why should the consumer court pass orders without verifying facts and force me to appeal to the Commission which overturns the Orders of the lower Forum? Why should the Forum not give compensation and cost for harassment and not honouring an insurance policy, only to be given when an appeal is made to the Commission? All such things are happening because there is no accountabilty for any order passed by the lower courts. A system for making judges/ magistrates accountable for their orders must be introduced. more

The problem is that if you go to personally file a case in court, the clerks don't allow you to file a case & keep giving flimsy excuses. It is difficult for a common citizen to understand their specific fomats & procedures. more

The point is about the paucity of time and facilitating court's time too. However as Uday mentioned pleading or presenting one's case requires PRIMARILY skills besides researching etc. On the other hand to address the challenge I would suggest the government and he judiciary act on recruiting judges -if I am correct the pending cases and lack of judges and courts can be something which when addressed even in a phased manner can improve the situation in a couple of years. more

Those of the Lawyers who have made a name for themselves would no doubt have high connections. Jethmalani's ( both father and son) have many politicians whose skin they saved, of course for a charge and when in need they would surely fall back on these political powers to bail them out. No IT official worth his salt would even dare to make inquiries with the Jethmalani's as just one phone call is sufficient to have them terminated/suspended.Surely they wouldn't be paying the IT for the entire earnings and being shrewd and clever liars nobody would leave any trace of the money trail....so also wouldn't any politician...even FM Jaitley against whom severe allegations were leveled by Kejriwal ( who himself was once an IT official ) and would definitely be knowing the truth but proving it would be difficult. more

But practically it is NOT possible, so to save time, money and efforts of all the parties including the Judiciary.
