Haldiram restaurant has been charging service tax on the "take away" or "pick-up" orders. Charging of service tax on such orders is not applicable as per service tax Act. This suggest pocketing of service tax. Your views on the same before the issue is taken up with Trade Tax authorities. more

Dear Sir, Section 2 (l) of Legal Metrology (Packaged commodities) Rules 2011 define MRP as : " “retail sale price” means the maximum price at which the commodity in packaged form may be sold to the consumer and the price shall be printed on the package in the manner given below; 'Maximum or Max. retail price......inclusive of all taxes or in the form MRP Rs.........incl., of all taxes after taking into account the fraction of less than fifty paisa to be rounded off to the preceding rupees and fraction of above 50 paise and up to 95 paise to the rounded off to fifty paise;" This includes each and every cost including transport, packing, VAT etc etc and not even a single penny is chargeable over and above the printed MRP. more

Dear SKV, I'll appreciate if you could quote the Section under Packaged Commodity Rules that says, "MRP inclusive of all taxes". As I understand, MRP is the 'Sales Price' exclusive of VAT which has got to be mentioned as a separate charge after giving the benefit of "set of'" value (for the information of the buyer (otherwise it will be the violation of the Right to Information under CPA 1986.). more

In case of packaged commodities, VAT is included in MRP. MRP is the maximum prices inclusive of all which can be charged by the traders at the most. . The traders have to separately show the amount of the VAT included in the prices. more
