I recall a judgement of the recent past (may be two-three years back), an employee of Railway at his age of 58 yrs. got implicated in a complaint of sexual harassment. He got dismissed later retired and struggled to contest the case. His retirement benefits got held up. After a good fight for 14 yrs. he got acquitted (clean chit) at the age of 72 yrs. with a penalty of Rs. 5 lakhs to the complainant.
1. Would you call it as a justice?
2. Who will bring back his reputation lost during 14 yrs and
3. there was no mention by the media. I feel he must have been defamed left and right by the media at the time of complaint.
4. Is it really an acquittal?
5. What is the utility of those retirement benefits which he was denied for 14 years and what would be the use of that money which cannot be used at the age of 72 yrs as what he would have used during 14 yrs of the retirement?
6. Is it inappropriate if the same level of the punishment to have been awarded to the complainant what would have been awarded to the accused in the same crime? more

Is he got the benefits from the Railways. If he is also got left over service benefits from the department from where he dismissed. Is there any court direction to pay all his dues after the judgement. more

Dear Mr. Rajendra Babbar, The penalty of Rs. 5.0 Lakhs was imposed on the complainant woman not the accused man. Hence the accused man was acquitted with clean chit and the complainant woman was penalised for fictitious complaint. The penalty would have been more has she not taken the shelter of inability to pay. more

Imposition of penalty shows that it was not a clean chit aquital. Hence there must have been a guilt on his part. more

Our courts do not have any justification, they do not look at the time, person, complexes, and the duration their desecration, we prolong the cases, we have long holidays/festivals, but we these do not benefit the people of the country. All lawyers/judges are responsible for this , they do not come to a desc-ion, on anything thinking of the magnanimity of the case/people. more

In CBI , cases eventhough they are investigating in a systematic manners but the judgements are delayed much due to this the culprits are escaped but some innocent officers have to wait for long years to get justice. If they quicken the lega process, it will be effective in curbing corruption at the same time innocentsa will get justice in time. more
