With regard to my mother's FD in Halios & Matheson Information Technology I would like to mention that the principle amount is not refunded by the company but I have the deposit receipt in original with me. Also I have the counterfoil of the bounced cheque and bank advice of bounced cheque. I also have the monthly interest warrant of January-2015 along with the advance principle amount warrant issued by the company which was not deposited in the bank as I was adviced by company's registered office in Mumbai on telephone. Moreover bank also deduct the handling charge for bounced cheque from my SB A/c. So, kindly advice about what next action can be taken to get back the principle amount.

Cheque bouncing is a criminal offence but there is a time limitation to proceed against, which is to be taken care of. The warrants issued against the principal amounts should have been presented in the bank and got dishonoured instead of complying with the telephonic request of the company, which is difficult to prove in the court of law. What is the present financial status of the company. Is it functioning or has become defunct? You should keep all these points in mind and consult a lawyer and act accordingly without further delay. more

Very interesting.You are getting interest on your deposit by cheque. But cheque is dishonoured. Good sent a legal notice and file a case. See the result. Keep all your documents including FDR safely. Dont worry. Cheque bouncing is a criminal offence. more

Bounced Cheques - you may go for 138 Of Negotiable Instrument Act - Provided it is NOT TIme Bared - If so you may go for (a) con-donation of the delay after filing the case (b) you may also adopt Consumer forum/Commission - symutinously. 2. You can also lodge criminal complaint in the nearby police station and obtain the FIR (Mostly police will deny) in that case you can file Private complaint in the Court for directions to police to register the case. 3. It is not clear as to why Mr Nagesh needs an advice from the Circle members when there are several options to proceed against such cheaters and known to every one. Secondly, people should discuss the legal points with practicing lawyer who can guide in a proper way. In my opinion, as afr as possible, we should avoid to refer all our petty issues to the circles, which are broadly meant for discussion on national issues. more
