My friend has recently bought a flat. The flat was shown by one broker initially and agreement to sell was also made, which could not be executed in time and as per the agreement conditions, mainly because of mis-information provided by the broker. Later, my friend succeeded in purchasing the same flat through another broker who provided all assistance for registration etc and he paid the brokerage fee to him. The previous broker, who was still the broker of the seller, is now also asking his commission from my friend as well and when it was refused, he is threatening to lodge a FIR. There was no agreement with him by him for payment of the commission at any time.
What is the legal position in this, can any one advise please. more
