Adultery

So with this new judgement a man can have as many affairs or sexual relationships and it wont be crime.

However what happens if a man does this and lady wants divorce because her husband sleeps around. Will he be required under law to give divorce and then pay alimony/child care.

Personally, with such laws we are encouraging affairs of both men and women and we wont move forward as a society but move backward. more

These contracts make sense in world we have become mean to the core. High time we legalize contract marriages in India. more

India is a sick society, a mental asylum of all that is rotten. The way many reacted to the judgement itself is an evidence. Why are we following the idiotic law passed by the erstwhile colonial masters. I wonder how can adultery be considered a criminal act? Adultery is not something new. It is as old as human history. Man alone is punished for adultery, while woman is not. All kinds of excuses are put forward to defend her. why can't we have gender neutral laws, laws that have clarity. Adultery does not lead to collapse of society, if that was the case our society should have disintegrated long ago. Proof is very solid. for all to see. if you look away to the other side, i can't waste my time arguing with you. In adultery, both man and woman are involved. Instead of inquiring why they got into that relationship, our law was only eager to criminalise it. Another thing as per our law is that man cannot have sex with another married woman unless she has permission from her husband. What a grand idea to start a home based prostitution business! And if the man had sex with an unmarried woman, then law views it differently. Sex is a normal human urge. if wife cannot give it to husband or the husband cannot give it to the wife, the possibility is that it will find a way to seek it. Sometimes it will end up with two people getting into an illicit relationship, sometimes it takes another form, not a relationship, but collecting or possessing things, greed for money and property, over eating etc. these are few of the manifestations, if not treated could also lead to marital tensions. Every man or woman will wish their wife/husband is handsome, has good physical attributes, responds to their physical needs. These are basic needs. Many Indians after a certain age head towards spirituality, not because they got an inner call; they realised that they are sick, unhealthy and not fit enough for a healthy sexual life. That is the hard truth. But they will not admit it. If her or her spouse is in an adulterous relationship, the best thing is to talk about together and then take a fast decision. Going to police station will not help now. The courts will take atleast a decade to pass a verdict. The best way to separate by divorce. Compromised life is not a life at all. Take a divorce and life your life on your own terms. That will certainly not lead to disintegration of the society. more  
The question raised is such that Women should have equal right of Sex OR, Women should be also punished while Women also should have the right to Sue her Husband .
Whatever be the Question or, even if these 3 questions are raised in terms of Equality and Equal Opportunity, S.C. if refer earlier Judgments of Supreme Court of the year 1985 and , 1988 , THE JUDGMENT WOULD HAVE HIGHLIGHTED THE ISSUE OF ethics and Morals of Society that are aimed at Safe and Secured Status of Women in the Society.
WORLD HAD COME OUT FROM EARLIER PRACTICE OF MIGHTY OR MUSCLE POWER GAINING A WOMAN but now, the mighty/ muscle-power will be replaced by WEALTHY/ CONVINCING-POWER . But, this also give scope for Jealousy, rivalry and vengeance in the Society between Ex-Couple and the 3rd party involved . BECAUSE, IT IS THE KNOWN FACT THAT LAW IMPOSED PUNISHMENT FOR HUSBAND IF COHABITATED DURING THE PERIOD OF SEPARATION TEST since natural law is such. more  
The very basic of marriage is remaining loyal to each other, emotionally and physically. The judgment has a sentence saying that 'marriage does not mean limiting choices' or words to that affect. Then what is marriage? If restrictions is not part of marriage or even social life then what is it? If we can go on satisfying our urge with whomsoever, we feel is our choice, then why marry? And at this rate soon fathers may suspect the children of being from somebody else. Yes, court said, morally it may be wrong. But with village elders and various versions of khap panchayats (that used to ensure morals earlier) loosing hold, who enforces morals now? Isnt the rule of law replacing moral policing in a civilised society? Can the law be independent of morals required for society? And isnt it an part of agreement of marriage to remain physically loyal to each other? If yes then isnt it the duty of law to ensure that agreements are respected? Very confusing verdict in my opinion. more  
Very correct version. “ The rules of Natural Justice owed their origin to ethical and moral Code'. 'Can any body be bold enough to assert that ethics and morality are outside the field of legal formulations ? ' IS THE ISSUE AND ESSENCE TO BE CROWNED FOR CRIMINALIZING OFFENCES RELATING TO MARRIAGE.
This is to be the Rule of Law if we consider the special factors relating to Women,= “Women and children require special treatment on account of their very nature. Women’s physical structure and the performance of maternal functions place her at a disadvantage in the struggle for subsistence and her physical well-being becomes an object of public interest land care in order to preserve the strength and vigour of the race” .
If these essentially necessary factors are set aside in the aspire of individualism and equality, Society in any Region, Society in any Country can never be Safe and Peaceful since 'her physical well-being becomes an object of public interest land care in order to preserve the strength and vigour of the race ' AND RESULT IN EVER MOLESTED. more  
Ms. Sneha ji, Yes such adultery relationship may be cause for Divorce with appropriate compensation. It is no more Criminal offense under sec.497, which was 150 years old law. But, if the wife in her distress because of such relationship, commits suicide then he can be tried under Criminal section for abetting suicide. But this is may be the grounds for Divorce accordingly compensation will be allowed by the court. But please understand the court merely removed it from criminal offence. But never encouraged or intend to encourage for adultery or something else like this because of present trends & social fabric of the society. But plz note it did say that the men cannot treat the female as their property. Whether one involves in Adultery or not it is their personal choice. Of late, Women are supporting the family financially & enjoying Economy freedom, they demand respect & freedom. Like in a recent judgement SC has removed the consent adult gay sex as a Criminal Act under sec.377. But SC never encouraged for such act. It just said it is no more Criminal Act. But the media has blown out of proportion in its report gathering eyeballs./ TRP. Now the thinking is entirely different among the youngsters thanks to Market Economy. Sex before Marriage was taboo in older days but no more now. One girl was answering, when a question asked why you indulge in such act, she coolly responds that they wanted to test his ability to satisfy them sexually, even after the marriage. So called the Love marriages are getting increased of late, criticizing the arranged marriage. Yes it is arranged marriage, we do take the opinion of the both Boy & Girl with their concurrence only then we go ahead with the marriage, it is not forced marriage. These kind of disruption is happening not only in Metro cities but in tier 2 and tier 3 cities in a higher percentage, there will be one story at least reported daily in the newspaper of girl eloping with a boy or the boy eloping with the girl he has loved or in relationship during or a day before marriage embarrassing every one. As long as the society is Money oriented & driven by the Market Economy the values, civil behaviors, habits do change whether it is with boys or girls it is immaterial.
