Advice regarding selling of flats in tower which has no society formed.

Hi,
Please guide 1)Builder is asking a huge amount in name of transfer fees.a) A flat which is in tenants name ..
b) a flat which was duly registered.
Is the builder entitled to collect transfer fees for giving Noc.. more

Builder is NOT entailed, unless there is specific condition/s in the previous agreement. You are accountable to the seller who Owns it. Pl. be careful for the Sale Agreement between the New Seller and the Buyer that is YOU. more  
As I told you earlier, once a building is complete, the builder has no business to be there except for handing over the structure/flats to the buyers. Thereafter, the buyers may sell the flat on their as per the terms and conditions of the loaners who need to be taken into the loop for repayment of the loan. Builders have no business to be there after completion and getting the completion certificate from the authorities. Thereafter, the buyers may have their own society to manage the affairs and building maintenance and rules for resale the flats. Terms and Conditions of the Society are drawn up with the consent of membership of the flat owners. more  
The GOVT should not register an ASSOCIATION for FLAT OWNERS as it is just like MONEY LENDERS ASSOCIATION.And instead ......Aparment RESIDENTIALS WELFARE ASSOCIATION should be registered in order to solve all problems at the APARTMENT . more  
Societies formed by the flat owners are absolutely for maintenance of the premises. They can't set any terms and conditions for reselling any flat by any owner. They have absolute discretion to decide. The only clause the societies can add in their bye-laws is 'to give priority to the societies' members if any of the members decides to sell his flat'. more  
If the flat is purchased outright and duly registered in favour of the purchaser, does its reselling require a NOC from the builder? I don't think so. In my case, I had sold my flat in Bhopal and directly registered the sale deed in favour of the purchaser without obtaining any NOC from anywhere, without any problem. more  
Mr. Chouhan, you may tell the builder, "Go to hell. You will not be paid any fees for transfer of the Tower you built for the society. On completion you have go to hand over the same to its members who will have their own society to maintain the same. If you do not hand it over, we will go to the court." You have a strong case. There are instances of court judgments. more  
No such fee is payable. In fact the dealing is between a seller and a buyer
