Amendment in Hindu Marriage Act
Dear Honorable Members,
Its great that Triple Talaaq has been termed as unconstitutional by the Honorable Supreme Court. But how about the amendment in the Hindu Marriage Act. I remember that during the UPA government, a lot of discussion was ongoing on this issue. But then the discussion has stopped completely. I think that time has come to have the amendment of “irretrievable breakdown of marriage” as a ground for divorce in the Hindu Marriage Act. Above all, religion is for life.. If life is in danger, then what for religion is?? The recent incident of "Love Jihad" is perhaps the result of such an agoni.

True. The S.C. directions on Triple Talaq entering into that Religion's practice of Divorcing the Women is absolutely at the gravity of Peaceful , Safe and Secured life with equal Status in the Family/Society/life-lead . Here, the concept is the both ' Justice , moral , social and Goodness ' as well as the duty of minimizing the Diverse issues that leads to nullity of provisions of article 21 read with 14 . The tightened laws of DVA etc., and Section 498 A are also to be read with Articles 21 and 14 , the life of Citizen as well as the pride of the Constitution . The holy & highly Unique qualities of FEMALE shall not be neglected in Pleasantness , honourable Status or not to be diversified for any inhuman , unnatural , and immoral Selfishness of any , under any and thus to be set at GILT EDGED SECURITY and , this is under only the Family System and Custom . There shall not be any diluted or diversified derivation of this System and Custom as , Slavery or Bondedness which are not practiced in India OR Deprived and or Discriminated as appearing in the text adopted . The laws already much tightened only on the object of protecting Women in the Country except the 2005 Amendment Act which went on misuse by both Male & Female . more

The opted issues that have been leading to Divorce and , even making the issue of proposed Marriage on love conceded to dilution and some times threats just on the issue of effects of the recent property act amendment of 2005 .
The amended Act had its twofold effect on the Marital Status and Family in India as well as the opted Marriages on the concept of wealth & properties of the Female .
There have been suicides and disastrous life lead and even defame in Social Status of Male too . more

what do u mean Mr.Sharma ?
I know that a woman has right on his father's property as also right on property on in-law side.
But a man has right on property of his own family only, not on his in-laws family more

Argument is self defeating talaq case was to retain marriage and divorce is to annul it which is exception and cannot be a rule more

Well...trust our politicians and our celluloid stars where bigamy, polygamy, incestuous relations are all on display over the years and even the law has turned a blind eye to it. Politicians conveniently forget it when it comes to their own rank and file being involved. Take for example: Dilawar Khan & Aisha Bi got married in 1974 converting to Islam as Dilawar was already married and a father of 4 children and his punjabi wife refused to divorce him or give permission for a second marriage...so the dream girl and her He-man chucked their religion and embraced Islam for a marriage of convenience. They were right...nobody bothered...neither law...nor the Hindu forces....nor the maulvi's.. both are now BJP - MP's. A party which propagates Love-Jihad and incites religious differences. more

When we talk of DHARMA (especially Hindu Dharma), we also know of Istri Dharma mentioned in Hindu Vedic Dharma. Does Law take cognizance of Istri Dharma as well or only Purush Dharma has been codified? If so, isn't it one sided and needs a comprehensive overhaul? more

Unfortunately only Purush has duties as per the Hindu Marriage Act. Even Domestic Violence, harassment are not gender neutral. They automatically assume that the husband & his family are the evil people.
Which is why it is not 'Dharma' but demonisation of the Hindu Male, so that even the Jawans at the borders can be harassed while doing emergency duty & the nation weakened. more
