Hi ..what should be the action if some govt dues have been found on the purchased property which was not paid deliberately by the owner? more

Mr. Shiv Charan, it appears that you have not done all the due diligence by searching/ verifying all the documents before purchasing the property with all the Govt. Departments, viz., Land Records, Municipal/ Panchayat, Land Types, Electricity Department, Property Hypothetication etc. Once property is registered in the new name, all dues will have to be paid by new owners. By filing court cases, you will loose more money and various litigation costs and it will drag to your life time. So relax your mind, for not being careful at the beginning and look forward for a happy & peaceful life. more  
The Sale Deed generally include a declaration by the Vendors that they have paid all dues and Taxes to the Government and that there are no dues on the Schedule Property . IF THIS CLAUSE EXIST, YOU CAN PROCEED LEGALLY ON THE VENDORS. Further, there will be another declaration by the Vendors that there are no encumbrances and mortgages on the Schedule property and that there are no dues and if at all any found in future, the Vendors hereby guarantee to make good any such losses at their cost and make the property for full and absolute enjoyment by the Vendees, their successors and heirs . THIS CLAUSE ALSO LEGALLY BINDS THE SELLERS TO THE PURCHASERS. Any Lawyer will guide perfectly on this issue making the Sellers responsible to clear all the dues even to the government. If such clauses are purposefully avoided in the Agreement [ If acknowledged with part payment ] , Deed of Sale, the responsibility of clearing the dues on such Property lies on the Purchaser only . more

The buyer is required to obtain no-dues certificate from the appropriate authorities. Once the property is transferred, nothing can be done about the past dues and the the biyer has to pay all previous dues. more  
You say he deliberately avoiding the arrears to the Govt entity, please ask him in writing his intention on not paying the arrears. Firstly, you should know his intention before confiscating the property. Convey this to your higher authorities for due course of action. On his guidance, written instructions, you can take action on him legally. more
