Bank negligence- documents lost
IDBI bank misplaced all originals of my house documents. They never informed me till the loan was closed
Can I get the bank

AS FAR AS HOUSE DOCUMENTS ARE CONCERNED YOU CAN GET THEM AT SUB REGISTRAR OFFICE WHERE YOU GOT YOUR HOUSE REGISTERED WITH SOME EFFORT. AND OFCOURSE, YOU CAN SUE THE BANK FOR THEIR IRRESPONSIBILITY. more

Presume you retain photocopies before giving the originals to the bank. This is standard process. If the sale deed has been registered and the registration number is available, you can procure a duplicate through MRO by submitting an affidavit and valid supporting documents. Then you can follow up with the bank to see what they will do. what was the tenure of the loan? It is highly unlikely banks losing documents. Do check with them once. more

I advise you to file a suit in civil court and claim damages from the bank. Ask the bank to give press release about the loss of the documents and warning the public about possible fraudulent misuse of the documents. Get an order from the court directing the bank to obtain the certified copies of all the documents from the sub-registrar. All the expenses should be borne by the bank. Keep all these documents safely with you. Please note that in the absence of original documents, any buyer will be put on guard while buying the property and consequently the value of the property goes down. more

Also immediately do the following 1. Let the Bank give press release regarding the loss of documents 2. Pl.obtain an indemnity letter from the Bank that in case the documents are illegally used by some third party, you will be indemnified by the Bank. 3. Also intimate the sub registrar office through the Bank about the loss of documents more

You can have a certified copy of the title deed of the housing property from the office of the concerned Sub-Register on application and payment of nominal fees, for which it is better to hire a lawyer dealing with such matters. Remember, the concerned registering authority is the only competent authority to issue a certified copy of the document. Meanwhile, obtain a suitable letter from the bank advising that the original documents have been lost at their end along with an undertaking that all incidental charges relating to obtaining certified copies, notification, legal expenses etc. will be borne by them. On obtaining the letter from the bank stating misplacement of the documents, you will require to notify in the local news papers stating that "the documents so lost have automatically become null & void and holding thereof by any third person will be completely unauthorised & illegal and in no way merely holding of the documents will confer on them any kind of legal advantage, what-so-ever it may be." more
