"morality, humanity and Goodness" is diminishing, under the pretext of PROCEDURE, particularly in District and below. The very purpose of Justice should prevail and NOT the procedure which is mean to end and NOT end. Submission of application by the very Complainant is denied by the Hon'ble JMFC court, for reason of Single page application is not in prescribed manner as desired, BUT the contents of the application i.e. the very ORDER's of Hon'ble HC was denied. more

HOW CAN YOU TRUST A MAN OR WOMAN WITHOUT SUFFICIENT TIME TO GET TO KNOW THE PERSON MORE CLOSELY ?? MOST OF THE MARRIAGES ARRANGED BY GREEDY FRIENDS OR RELATIVES (WHEN THE RESPONSIBLE FATHER IS DEAD ) ENDS IN A BAD MARRIAGE ,WHY ? DOWRY HAD BEEN BANNED AND INSTEAD OF THAT , THE BROKERS ARRANGE FOR "COMMISSION' TO THE RELATIVES FOR FORCING THE MAN OR WOMAN TO AGREE TO MARRY AN UN-SUITABLE INCOMPATIBLE PERSON. IN SHORT, MARRIAGES HAVE BECOME SUBJECT TO INTENSE SEXPLOITATION BY THE POLITICAL CRIMINAL CLASSES AND THEIR BROKERS. THE RESULT IS TURMOIL IN THE FAMILY, SEPARATION AND DIVORCE. THE INNOCENT CHILDREN ARE AFFECTED. WHO CARES ?? ALL CRIMINALS IN KHAKI, BLACK AND WHITE GET HUGE INCOME FROM THE EXPLOITED CITIZENS. SO, IF THE PRESENT B.J.P. GOVT. IS GENUINELY CONCERNED ABOUT THE EXPLOITATION BY THE CORRUPTED JUDICIARY , IT SHOULD TAKE IMMEDIATE MEASURES AND BRING ABOUT THE NECESSARY CHANGES IN THE FAMILY COURTS OF INDIA. HOW ? 1) ALL "FRAUD' ADVOCATES MUST BE REMOVED FROM THE JUDICIAL SYSTEM. ALL THE LEGAL PROCEDURES THAT ARE TO BE FOLLOWED BY BOTH THE LITIGANTS AND ADVOCATES MUST BE DISPLAYED ON THE WALLS OF THE FAMILY COURTS , IN THE REGIONAL LANGUAGES AND ENGLISH . Pertinent laws carry means of a benefit of doubt/ Clause that carries the discretion of the Judge AND , such are ruining the life miserable where inability & impossibility sustain which need the help of an additional caretaker in the Family .
This is all due to the lapse of ground facts being sidetracked in strengthening the issues opted . This injustice can only be eradicated through removal of law loop-holes AND IS THE NEED OF THE HOUR . more

Sorry, one more suggestion. All cases should be decided as per the Law and not the discretion of the Judges. Mr. Modi had himself raised this issue with the then Chief Justice of Supreme Court. more

Sir, I have two suggestions. First, courts should take Perjury seriously and then, there will not be false applications and evidences. And the responsibility of perjury should not only be for Parties but also for the Advocates because, they always know the truth. Punishment under perjury is up to 7 years of Jail and fine.
Second, conduct all court proceedings under Camera. Some people have raised the question regarding cost for installing and maintaining CCTVs. Answer is very simple. Give the copy of relevant CCTV footage to every party by charging some amount, say Rs. 50 per footage. If 50 cases are heard every day in a court room and there are 20 court rooms in a court, 1,000 cases are heard involving 2,000 parties as every case has two parties each. It will fetch nearly 1 Lakh of Rupees per day, per court. Hope, this amount is sufficient to install and maintain CCTVs in courts. more

"THE ROAD TO PERDITION IS ALWAYS PAVED WITH GOOD INTENTIONS " !! NO DOUBT THE SUPREME COURT BENCH HAD GOOD INTENTIONS WHILE DECLARING THAT "TRIPLE TALAAQ' WAS "ULTRA VIRES' . BUT WHAT ABOUT THE TRAGIC CONSEQUENCES THAT MOST INDIAN CITIZENS, BOTH MEN AND WOMEN, OF ALL RELIGIONS, ARE PRESENTLY FACING IN THE FAMILY COURTS WHERE "MEDIOCRITY RULES THE ROOST ' ???? AN EDUCATED RIGHT-THINKING PERSON WHO HAS GONE THROUGH THE USUAL PROCEEDINGS ADAPTED BY THE "EMPOWERED" WOMEN JUDGES WILL DEFINITELY REGARD THESE COURTS AS A FARCE , FOR DISPENSING INJUSTICE AND FOR EXPLOITATION OF LITIGANTS BY THE CRIMINALS IN BLACK !! WHEN IS THE SUPREME COURT GOING TO ENSURE THAT THESE COURTS FUNCTION IN A MORE CIVILIZED AND EFFECTIVE MANNER ?? 1)ACCORDING TO THE FAMILY COURT ACT, THE FIRST PROCEDURE THAT ALL LITIGANTS HAVE TO UNDERGO IS "COUNSELLING' , WHICH MAY CONTINUE FOR SEVERAL YEARS. LITIGANTS AND THEIR ADVOCATES ARE NEVER IN FORMED (BY POST OR ELECTRONIC MEDIA) WHENEVER THERE IS NO SITTING !! (WHILE THE LITIGANTS KEEP STANDING FOR HOURS , IN THE HOT SUN OR RAIN ) !! 2)SINCE I REFUSED ANY KIND OF COMPROMISE WITH A SPOUSE CONNECTED WITH THE POLITICAL MAFIA (K.C. -JACOB) , I REFUSED TO ATTEND COUNSELLING. THE FAMILY COURT KEPT SENDING NOTICE FOR ATTENDING THE COUNSELLING. FINALLY AFTER ABOUT 3 YEARS OF THIS INJUSTICE , I FILED AN APPEAL BEFORE THE HIGH COURT OF KERALA, WHICH RULED THAT "COUNSELLING IS NOT MANDATORY FOR THE LITIGANTS". BUT EVEN AFTER THE HIGH COURT ISSUED THIS RULING, THE HYSTERICAL JUDGE HEMA CONTINUED SENDING THIS NOTICE !! CONTEMPT OF THE HIGH COURT , WHAT ELSE ?? SO, ALL THOSE WHO ARE ENTERING THESE " INFAMOUS COURTS OF INJUSTICE" FOR THE FIRST TIME, REMEMBER THAT COUNSELLING IS SIMPLY INVENTED TO WASTE YOUR HARD-EARNED SAVINGS ,FOR THE BENEFIT OF THE POLITICIZED CRIMINALS IN BLACK !! YOUR MONEY IS FOR YOUR FAMILY , NOT FOR GIVING TO CRIMINALS. more

You may be right. Usually, one line statement is filed in the court, if counselling is failed. A solution to this problem would be that, proceedings of Counselling should be minuted, signed by both the parties and filed in the court. under these circumstances, the truth will come to the court and accordingly, a fair decision can be taken. more

TRIVANDRUM FAMILY COURTS. ) IN GUJARATH STATE , ELDER CITIZENS HAVE FORMULATED A KIND OF LIVING-IN STYLE , CALLED "MAITHRI KARAAR" ( WHICH IS NOT RECOGNIZED AS BEING LEGAL MARRIAGE BY THE COURTS ) THOUGH LIVING-IN IS NOT ILLEGAL IN INDIA ,ACCORDING TO SUPREME COURT, ONLY SEC. 420 OF THE I.P.C. WILL BE APPLICABLE IF EITHER OF THE PARTNERS DECIDE TO CHEAT OR IF THE MAN CLAIMS THAT THE BABY BORN IS NOT HIS BABY !!! T THIS KIND OF SITUATION OCCURS IN CONVENTIONAL MARRIAGES AS WELL , DUE TO "SEXUAL EMPOWERMENT OF WOMEN" !! THE RESULT IS MORE AND MORE DIVORCE CASES REACHING THE COURTS, EVERY DAY. SO, MORE AND MORE JUDGES AND ADVOCATES GET HUNDREDS OF CLIENTS . NOW, MORE MUSLIMS WILL BE SPENDING LAKHS OF THEIR HARD-EARNED SAVINGS ON DIVORCE CASE LITIGATION, DUE TO SUPREME COURT BAN ON "TRIPLE TALAQ". SO, LOGICALLY SPEAKING, THOSE WOMEN WHO PREFER TO ENJOY SEX BEFORE MARRIAGE ( ALMOST 75 % OF WOMEN DO) , NEED NOT EXPECT THEIR HUSBANDS TO REMAIN FAITHFUL AFTER YOUR MARRIAGE. If such a Law is implemented that, a marriage takes place only after both parties have lived together for a while and a baby is in waiting, we are aware of abuse of such a practice, when people marry and after a child is born, they desert the women and go absconding. Majority of ladies, involved in flesh trade, are victims of this practice. Therefore, at least, such a law cannot be framed in countries like India, because people of different caste and community live here and they have their own personal Laws of Marriage.
Before, such a Law can be implemented, there is a need of Uniform Civil code. more

True. The S.C. directions on Triple Talaq entering into that Religion's practice of Divorcing the Women is absolutely at the gravity of Peaceful , Safe and Secured life with equal Status in the Family/Society/life-lead .
Here, the concept is the both ' Justice , moral , social and Goodness ' as well as the duty of minimizing the Diverse issues that leads to nullity of provisions of article 21 read with 14 .
The tightened laws of DVA etc., and Section 498 A are also to be read with Articles 21 and 14 , the life of Citizen as well as the pride of the Constitution . more

PRIME REQUISITE is that : Any issue that tenders information on Financial Crimes , Terrorism , Misuse , Misappropriation , Corruption , Concealed Tax & Wealth shall be allowed by S.C. recognizing the cognizant issues of Corruption , Concealed Taxes/Duties and Wealth ; Misuse and Mis-allocation ; Misappropriation and Cheating public and and even Government . It is necessary to achieve this for a prompt run of public administration as well as governance that shall not allow or lead with carried Rule with these National as well as Citizen Evils . Country cannot sustain Economy / Wealth , Justice as well as Security of its own people . more
