Being harassed by a Lawyer and Collection Agency.
I have received a notice by email, from a lawyer, a week ago, that I owe a bank Rs. 7 crores against my credit card. I do not have a credit card from this bank since 1996. that is 20+ years. I do not have an account with this bank for the last 20 years, and do not even recall that I had this bank's credit card. In the last 15 to 20 years I have not received any statement of accounts, letters or any form of notice from this bank.
The lawyers notice says that the bank has "Sold" my account to a collection agency in 2010, and that the collection agency will collect from me.
Kindly inform me as to what I should do in such a case. What is the statute of limitation on credit card payments. Please help. more

Mr.Cama why do you respond for such calls/emails as all are bogus. We are also getting such mails /calls but on reply by mails they go underground. So as per the constitution of India if any case is filed against you you will get summoned from the court. So even if you do not respond to any legal notice in writing it is not a matter but you can engage a lawyer and submit your prayer to the learned judge. Issue closed for ever. You never respond for such call. If he calls again simply say that the matter has been reported to our Hon.PM's office and cyber police.Thing is over. Do not give any commitment which may be a record later. The lawyers notice is to be received in writing with facts for which we will reply. My close relative is a judge who told me every possibility to file a defamation suit for 100 times against his false demand . I have no objection to divert his calls to me so that I will reply suitable being member of the Prime Minister's Circles. more

Captain Phiroze Cama: If you care to read my mails carefully, I had asked you to make a full disclosure for getting proper advice. The lawyer has rung up today but you hung up. You must read agreement that you signed with the banker (An e-mail notice is admissible as per bank agreement). Also see your past records to ensure that you did not have any outstanding when you discontinued your credit card more

Dear Mr. Ravindran, just after I replied to your last post, I received a call (first call) from the lawyer who sent me that letter of demand. I told him that he has the wrong number and hung up. He then called around a dozen times, but I did not pick up any of my phones, including my cell phone. Seems he has all my telephone numbers. This is just for your information. more
