BIILS / INVOICES FROM RESTAURANTS :
There has been a lot of queries and doubts about the Hotel billing the customers . Now I have attached a bill /invoice made on 29th July . Though the prices were not for frequent eaters , I found the the billing / invoicing clear for the customer .
This restaurant charges 18 % G.S.T.[9 for state and 9 % for the center and 9% for the state .] The price of food stuff is mentioned clearly . That is exactly what is there in the
" Menu card ". The prices in the menu cards are not the M.R.P. as but the basic prices that includes service charges that include the the charges for the atmosphere , A/C environment and ambiance and all charges for the preparations of food. Here the waiters' tip is not mandatory but optional to the customer .
The second attachment " Menu card " is just to inform the readers that the price mentioned is not M.R.P. it is thee basic price of the food to be ordered ; that price included the service charges .

I am amused. The restaurant bill posted by Mr Daniel makes, except GST, no mention of service charge or service tax or any other tax. Why all this discussion then? For information: the word "virgin" before any drink/cocktail denotes that it is alcohol-free. more

Ha ha ! Mr. Ratti .There was a circular from the Ministry of consumeraffairs in April clarifying service charges , making it not mandatory to pay tops and clearly indicating it is an option. There was a news item also from the Minister Mr. Paswan .I can attach it only in a resource post . So I will do it. more

The hoteliers are overcharging us. The introduction of GST has come to them as a big chance to overcharge the customers and make huge unfair profit from this overcharging. Govt will not react due to obvious reasons. GST is not an additional tax to the existing taxes. It is a tax in lieau of all existing 16 taxes. That means they don't have to pay all those taxes they were paying earlier but pay only GST now. The hoteliers are now charging all those earlier taxes from customers and in addition , they are charging GST also. Even in GST they are overcharging. A/c restaurants can charge 18 % GST and non A/c restaurants can charge 12 %. In Mumbai even non A/c restaurants are charging 18 % GST. Will anyone listen ? more

With due respect Sir, as correctly pointed out by Mr. Mukul Mohan Mittal, they have mentioned TIN No. on invoice and not GSTIN and therefore, they are not authorized to charge GST. Second, in case of GST invoice, it is mandatory to mention HSN Code, which is missing from the invoice. Third, I believe Pina Colada is an alcoholic cocktail and Liquor is out of GST ambit. Fourth, they cannot include Service Charge in the base price. If they are charging Service Charge, it has to be mentioned separately, because paying service charge is discretionary and the customer wouldn't know whether Service Charge is charged or not, unless it is distinctly mentioned on invoice. In case, the price mentioned in Menu is base price, excluding Taxes, it has to be clearly mentioned on Menu. But, it has been observed that, restaurants have not revised their Menu cards after the implementation of GST and earlier rates mentioned on Menu, which were inclusive of Taxes (VAT) are now being used as Base price and GST is being charged over and above those prices. Correctly mentioned by Mr. Surendra Pai, it is a day light robbery. Please take up the matter with the restaurant, if you visit them again. more

I totally agrre with Mr.Atul Jauhari, that this restaurant is not at all registered under GST,hence they are not suppose to charge GST.As they have charged the are liable for GST and penal action. Please write to GST (Central Excise)Officers of the jurisdiction with the above bill having TIN Nos. but not having GST No. They will take suitable action.
Secondly it is a fact that the restaurant owners are overcharges. As thery were paying tax before GST, their menucard value was inclusive of tax. For charging GST they should take less value that menucard value and then calculate GST on the same, any pay to Govt. more
