Builder asking GST on already constructed property

The issue I am facing is , I bought a flat in Bangalore and the builder applied for OC in July 2017 itself which means the construction is completed as OC can only be applied after completion of project but he is still asking for GST on remaining amount , Also as you are already aware none of the builders are committing on input credit tax, May be GST is good for nations and in long term may help , but because of all these non clarity and no place to complain the things are a big burden on common man , you anti profiteering branch , i tried to reach and escalated but no use , nobody cares about common ta payer who is paying around 60 percent in direct indirect tax, whole burden is getting passed to him . call me on 9952097698 for discussing more

what is the use of the Local Circles. Restaurants in Mumbai are still applying service tax of 10% and it is embarrassing to keep arguing with them that they are not allowed to charge this amount, it is illegal but what can the common man do? Who should he report it to? Jia an expensive restaurant at Colaba, Mumbai charges us the 10% Service Charge and when we intervened they said it was the management policy. Can the government not issue licences without taking assurance from the owners that no Service Charge will be levied. more
Most of us are confused about GST. If a builder has obtained OC before 01/07/17 and advised all the buyers to clear all payments by 30/06/17, then the buyer will pay all applicable taxes (not GST) upto 30/06/17. Thereafter from 01/07/17, any payment made will attract applicable GST, whether OC was obtained long before. Similarly for any ready-to-move flat payments will go by current GST. Builders are supposed to reduce the cost by adjusting 'Input Tax Credit', but being in India, where corruption is the rule, the builders are submitting GST returns after availing 'Input Tax Credit' and pocketing the extra profit into themselves. However, many builders purchase various items on cash basis & pay labor wages by cash, without paying any taxes, so they will not account ITC benefits. When 2nd world war was over, UK prime minister appealed all retailers to sell earlier dated articles at the old prices, which they followed by keeping both old / new priced items on the rack together, so that customers can decide their preference. This is their patriotism. In Indian, most of the industry/ retailer try to maximize the profit whenever opportunity comes. more
INSTANT As per info., gathered through media reports and shared on this very website, on more than one occasion, - so also through posts on FB /Linkedin, in details, no such levy of GST on 'realty' , though indicated as to be under proposal, is not known to have been enacted and not in force. Perhaps, it may be useful and purposeful, for anyone so concerned, to resort to RTI and obtain a confirmation/UPDATE, from the Department; instead of groping in the dark , inconclusively. ADMN - is hereby requested to consolidate and have all such comments earlier posted ,so as to be readily available for viewing by one and all concerned . courtesy PS: Suggest to locate and go through one such media report, as recently as in June 2018, that refers to a suggestion from Mr Sisodia (of AAP, Del) , - 'proposing' and urging the government ' to levy GST on realty. So far as known, there has been no further report of any development since then. more
