Builder commits suicide..

I had booked a flat and has paid almost 98% of the amount. At present the building work is incomplete. The builder was suppose to give possession last year but is still pending. Now the builder has committed suicide. Now what should I do? more

What is the constitution of the Builder i.e. proprietor/ partnership/ firm/ company ? If it is proprietorship and you are holding the money receipt, then you can file money suit against the legal heirs of the builder. For all other varieties, you have recourse from other partners. However, take the help of a Lawyer. more  
A common man was expecting well protected law from BJP to control Builders. Consumer is an individual and builder has money, political, police and Muscle power. He can easily fix up a common man. There is should be a law on time bound construction and possession as per the agreement signed. Consumer court takes its own time and by the time a common suffers mentally and physically. It is shame to observe that, our BJP government failed to make law against such corrupt builders. I have repeatedly given proper suggestions through this circle. Who is the owner of the project? Who had signed the agreement on behalf of the Builder. Whether it is Propreitorship Firm, Partnership Firm or Company? You may file a complaint with the Muncipal Corporation against the owners of the plot/project. Send a legal notice also. In such cases if you know other puchasers also, form a group and obtain possession of the Construction project through Cour order. more

Before jumping to any conclusion please check the documents issued by the builder. Such as < Agreement to sale. Payment receipt, land documents, etc.> keep these documents ready. Death of builder doesn't mean end of the road. Consult a lawyer who is familiar with such cases. Considering that you have proper documents, you can take possession of your flat. May be it will take some time but you will be able to get the flat. Please do not panic. more
