BUILDER IS NOT GIVING POSSESSION AND DEMARCATION FOR A PLOT WHOSE SALE DEED WAS EXECUTED BY HIM.

Please advise me what can be done as per law if a builder who has executed sale deed in our favour after receiving full payments and dues but now he is not ready to give possession and demarcation. Many times we made application for giving us possession and demarcation but no reply given by him. When we contacted to builder office, his staff members orally said that we have no land and send us back. more

You can choose any of the following ways:- 1. Since RERA is already notified in Haryana, you may file a complaint thereunder. 2. If you have a proper Agreement to Sale, you can file a suit for specific performance. 3. If the documents & reminders are in writing, you can file a criminal complaint with the concerned police station. more  
In Tamilnadu, though the RERA is functional, very minimum complaints have been disposed. Many projectshave not been registered under the pretext, that the buildings are for PERSONAL USE. The BUILDERS vhave their own way of escaping from judicial review more

India is full of such cheats unfortunately due to the poor state of legal system and hardly any deterrents to these kinds of people. In my opinion no point in going to consumer court as even if you win, you won’t practically get anything without going through other courts. Civil suits are also very time consuming. On a more practical approach, you might want to do the following: 1. Approach RERA. They are still the best bet and I have heard that they have given some good judgements in customers favor in Haryana. 2. Make sure you engage a very good lawyer after careful research and preferably from a known circle. 3. Check out VR1 Consumer Awareness Group: http://www.vr1consumer.com and take their advice. 4. Write your issue in as many internet forums as you can mentioning name of the project, firm and probably their owners/directors so that other people don’t get cheated. 5. Also look at other companies owned by them and provide their list also. 6. Circulate your story with Builder details through social media – WhatsApp etc again to make more people aware about it. 7. Keep the copies of Common Area Maintenance Fee receipts safely to prove your case further. All the Best, SG more
