Builder Selling the parking Space

In A tower of Six floors, Builder has sold the ground floor for shops. This ground was initially promised as a parking lot to buyers. What action can one take against such builders & where to submit this complain ? more

I have the same issue at an apartment next to my house. We have the municipal approved plan which shows the place as parking and a small play area for kids. It is now some 8 shops / godowns. They place is a mess and there is heavy traffic and garbage lying all over the place. When you complain the owners pay bribes or use influence and nothing happens. They have actually told us on the face that no one can touch them as they pay everyone concerned. And they also know that every govt that comes in regularizing all illegal buildings. more  
What the original plan drawn and approved by the concerned authorities says. If the ground floor was shown as parking space, the case is yours. Only thing is to lodge a complain with the concerned authorities with request to remove the unauthorised constructions thereat at the builders' cost and make it suitable for parking. If the ground floor has been mentioned as parking space in the offer letters and agreements, that will also favour you to retrieve the promised parking. Go on legally fighting against the builders jointly by all the flat owners. more  
>Please check buyer-seller agreement carefully. Sometimes builders write in fine lines. If you find any ambiguity there, pls consult consumer forum. However, it is slight sluggish, you can not get relief as per expectations. >Go thru National Building Plan guidelines. >If your building has registered RWA, then it can serve a notice to builder while getting it signed this by all the residents. Pls dont forget to send copy of it to concerned Development Authority like GDA, Avas Vikas Parishad, HUDA etc. Normally they take immediate action on this. >Last resort is FIR. i hope it serves the purpose. more  
You have to first get the following- 1. On what basis the promise was made 2. The builder-buyer agreement 3. The Sanctioned or approved from the authority Maps & Drawings. 4. If the building is completed, then the completion drawings also. After that check the irregularities & lodge complaint to the following- 1. Development authority for any violation from the approved plans 2. Consumer court for any violations from the "promises" more
