car parkind issue

Sir my brother purchased a three bedroom flat.there are total 15 flats.of which 5 are 3bhk n 10 are 2bhk.
The builder has allowed car parking to 15 members as against to 12 parkings as per ghmc rules.(Hyderabad).also my brother has been allocated car parking very adjacent to Electrical mains. And earthing wire .also once fire broke out but by luck my brother could save his car from that electrical accident.since two years he has been requesting the builder and other flat members to allocate a safe area but they are not responding.Also the area allowed is not easy for parking.And even if parked with great difficulty it's Highly impossible to take the car out.pl suggest what can be done (.In documents it was mentioned as 1460sft flat of which 260 includes common area and carparking). Please suggest what can be done in this issue .my brother is facing the problem since two years. He has become completely upset and depressed He has put his hard earned money Also can a builder allot carparking justfew centimeters away from the electrical mains...and earthing wire. more

It seems the fact that there is NO PARKING area available. If it so then let us accept the naked fact and find some private parking &/or parking else where. more  
If the builder and the Residents' Association are both impervious to your pleas, you can take recourse to the Supreme Court directive that the builder should only charge for covered car park and not open car park. I Agree with Mr Damji, But its going to take too much time may be 3 to 5 yrs So I suggest you First Lodge FIR against Builder including MD, CEO and Marketing Head under Cheating and misselling Also Police will not register untill you provide them prove that you r suffering from 2 year so any written communication regarding this issue with builder will help you. more  
1. If there is a risk of fire, then there are supposed to be fire prevention equipments also. This is as per standard fire norms. 2. If there are multiple residential flats, then as per the National Building Codes (NBC), every 100 sqm of residential area needs one parking instead of 1 parking per flat. this code is referred to across the country. By that logic you should have been allotted 1.5 parking space. 3. If the maintenance is with the Residents welfare association, then the fault lies both with the builder as well as the RWA. 4. There are basic guidelines in the NBC on parking. Which includes approximately 2.5m x 5m space for each car, a mandatory 4-6m access road (depending upon the location). Adequate free access in case of emergency to the fire tender which should be accessible by the balconies of most flats. Purely based on your post & without looking at the drawings, site photos & documents.. There is a design flaw. Violation of the norms accepted across the country, maintenance negligence. The RWA & the builder are responsible for the violation. In case the GHMC rules say that the builder is right, then the rules are in violation with the NBC and can be challenged. more

I further suggest that under RTI (Right to Information) make an application to Town Planning department of Hyderabad Municipal Corporation (HMC), to get you the approved plan of your building.

If parking lots are not in accordance with the approved plan, then you make a written complaint to HMC, to redress your complaint.

You also make a complaint to Hyderabad Fire Brigade Department (HFBD) for making your brother's car parking very close to electric cabin.
Also ask HFBD to do fire audit of your building.
If there is any fire safety violation, then HFBD will take an appropriate action against the builder and Residents' Welfare Association of your building.

If there is any violation against approved plan, as stated in your Agreement of Sale and HMC approved plan, then you can refer the complaint to Telangana State Consumer Redressal Commissioner.

After you do all above works, if you still find that nothing is moving, then kindly email your complaint (only after you make written complaints as stated above, and waiting for reply for 30 days), email to our NGO, Moneylife Foundation, for your free guidance by email to legalhelp@moneylife.in more  
1. Study the terms and conditions of builder buyer agreement and see if there any violations in issue of parking site. If it violates, the complaint can be taken up under CPA. 2. If the parking affect the free passage to electrical installation, the complaint can be taken up under Electricity Act which mandate the secured access to electrical installation. I feel the issue be taken up with the builder in the first instance and preferably through written mode of communication and sending by speed post. In case the builder remain unresponsive to the issue, one can also take up the complaint wherein the deficiency in service be also included as non-responding/ non-redressal of the complaint also result into deficiency in service. more  
The cost of the flat inclusive car parking. I mean better car parking place. It is better case to be fought before consumer forum more
