CCTV recording of Court Trials - Circle Impact

In March last year, LocalCircles on citizen request had taken up the cause of installing CCTV recording of trials in courts in India to drive transparency and accountability in judiciary. 97% of those who voted supported the cause and 80% said they would be happy to pay for retrieval.

We are pleased to share with you that earlier this year Supreme Court has approved installation of CCTV cameras in one district court in each state. The link has the full story:

12 high courts since then have installed CCTVs in two districts each in their jurisdiction. We are hopeful that this in the years to come will become a nationwide roll out.

It is a huge victory for the members of the LocalCircles to have prevailed upon the Supreme court to initiate , albeit on experimental basis, a mechanism for video recording of proceedings at the district court level. We sincerely hope this will cover all courts, including the supreme court, one day if we relentlessly pursue this issue. Based on some very interesting discussions on this issue among the members, I like to express a few comments 1. There is a common feeling among the countrymen that the huge number of pending cases in various courts is a result of deliberate delays arising from unholy collusion among the court, the government, the executive, the lawyers and influential litigants. While the Indian Judiciary System is regarded with high esteem by many intellectuals globally, it is a pity that many in the country itself have such a low opinion about it. The onus lies on the CJI, the chief justices of high courts, the Law ministry and the PMO to uphold the sanctity of the system by acting in ways that generate confidence of the common men and women. 2. There is a question raised whether commenting or criticizing the action of the judiciary should amount to the contempt of the court. A reference is drawn as to if the actions of the PM or the President can be open for criticism , why not that of the court. As per the provision of the constitution the two are not on the same plane . The PM or the President represent the Executive , where as a judge is a part of the Judiciary. The Indian constitution says the Judiciary is above the Executive . It implies that we have to rely on the magnanimity of the Judiciary that it encourages healthy criticism of its function, thereby earns the trust and respect of the citizens. Agreeing to install CCTVs in the court is a positive message in this direction. 3. The system needs extensive reform. Where does reform comes from ? It comes mainly from two sources. One is through sustained demand and participation from the citizens. Today, thanks to the elements of social networking, we have powerful citizens' engagement platforms like the LocalCircles. We are also blessed with a government, which is inclined to listen to what people want to say. We must be able to use the power of these tools to its fullest potentials. 4. The second and the most essential driver of any key reform is the Legislature. The constitution bestows on it all the power to make or break the nation. It can undo all what the Judiciary or the Executive want to do or it can do what the other two refuse to do. Who elects the representatives who adorn this most powerful and august institution ? We, the electorate ! We must pause and reflect for a while and ask our conscious : are we discharging our responsibility, before we ask of the same from others The tragedy of the Indian Constitution is that it has specified no criteria as to who should be selected and elected to these unchallenged durbars ! Can we visualise a historic role for the LocalCircles to fill the void that the forefathers of the Indian Constitution left unattended ?? more  
the problem lies is Judiciary is not executive and executive is not judiciar. If judiciary passes an interim order the executive never cares the interim order. Similarly if executive makes an order judiciary is lenient . First limit adjournments to two or three. Remove vacation for courts and let them work as other government offices work more  
The CCTV's urgency is also in the work of the "Family Welfare Committee" in every district. But the police should not be in the committee it is very important. more

Its my practical exposure as I dealt my own case in NCDRC against Builder . Trust me the total cases pending around 3.25 Cr which is an embarrassing number as highest pending cases in the world and I bet you 80% of them are deliberately held due to rampant Nexus between Govt>Judiciary>Respondent more  
Not necessarily wealthy. Maintenance money taken from party is also used. more  
But the nexus practically scores on the wealthy Respondent i.e., the party . more  
I believe, by saying Respondent, you mean Advocate of Respondent because respondent cannot have direct access to Judiciary. Advocate is the via media. more  
Even SC is fallible. I have seen SC faulting twice in the same case and no justifications for the verdict. more  
You are correct that every judgement needs to justify the judgement with appropriate reasoning. But, courts cite only those reasons which favour the judgement. For example, if maintenance is to be granted to wife, the Judge may not cite that the husband is unemployed or doesn't have any regular source of income. Only those cases of this type, which reaches of SC can only have a remedy. But what about others? Because, not everyone reach up to SC. more
