Sir, charging of GST (earlier VAT) on discounted sale price is not justified at all and is an unfair trade practices. @ Shri Atul Jauhari Ji As long as discount is being offered on MRP, it is very clear that no tax is chargeable as the discounted price itself is MRP. I have brought out the issue through various posts and public domain including my blog. A copy of the issue written on my blog has already been sent to all defaulters retailers and is in the process of consolidating the complaints for a possible class action. I would like to update that Lifestyle, Pantaloons, Shoppersstop, Myntra, Jabong are doing unfair business. All the consumers buying from these retailers are being cheated and therefore a formal request seeking refund of the excess amount need to be made to the retailer. more

As long as trader pays tax on correct amount we cannot say it is unfair trade practice, infact some have understood that though discount on mrp is given & tax is calculated on mrp only based on software generated bills !! then you cannot say trader has cheated wrong conception !! more

The way I see it, this is an opportunity for vendors to increase their prices, either to pay GST (where they did not pay before), or simply raise their MRP, collaring a sizable profit, as well as pay GST. This is like RBI fiddling with rates, where banks just take this as a cue to, in turn, tinker rates to their advantage. Within 3 months prices will go back to either original rates, or become more. Whoever is cutting prices is doing so as business is disturbingly slack. more
