Charging of taxes on discounted sale price
As being brought earlier in my several posts about illegal charging of taxes on discounted sales prices, I am attaching a decision of a news report wherein the retailer has been penalised by Rs. 4,000/- for charging tax on the discounted sale price. I hope consumers who are being charged such taxes may consider taking up their complaints before consumer forum. Any assistance in understanding the issue would be available. more

@Shri Ranjit Biswas Ji, Sir, this hardly makes any difference whether it is VAT or GST or whether it is pre-GST period or post GST period. The fact is that the discounted price is inclusive of all taxes whether VAT or GST and hence additional charging of any tax on discounted price is illegal and unfair business practices. @Shri Gopalbandhu Mohapatra Ji, Sir, this is not the subject matter of GST monitoring unit as the matter is in the domain of Legal Metrology. Legal Metrology can impose the penalty on the business units for violation. Recently Legal Metrology of Govt. of Haryana have challaned Home Saaz adapting to the similar practices of charging tax on discounted prices, the sale of which was offered at 40%. more

The instant case is related to pre-GST era but as far as the GST is concerned, the government should have come out with clear guidelines in this regard by now! more

The GST monitoring unit should initiate corrective action in the shape of educating the business men and in case of non-implementation, there should be imposition of heavy penalty. more

It is an encouraging news . But let it not be a token case and that continue on , on the perpetrators so that they also realize that they are doing wrong to the public and it will o more be toleratated ., more
