cheating by TATA Housing (Rio-De Goa Project)

I am an academic and this is regarding cheating by Tata housing. I saw the advertisement on internet regarding a housingproject in Goa(code name: Rio De Goa) which showed a 360 degree view of a flat. As I was interested in having a retirement home in Goa, I made the online payment of the token amount of worth Rs. 30000/- for a duplex. As the advertisement was from a reputed company such as TATA Housing, I had no doubts about the security of my payment.

Later on I was contacted by the company and I was informedI will have to sign a pre-rera agreement which I refused to sign. As this information was not given to me at the time of payment of token amount, I felt cheated. As far as I know, this is illegal to be asked to sign an agreement which is essentially against the customer.

Furthermore following information was also not given to me:

(i) detailed layout plan of the apartment,

(ii) detailed layout plan of the location of 14 tours and
amenities provided in the complex,

(iii) details of building material to be used in the bathroom,

(iv) details of electrical wiring etc,

(v) a fixed date on which apartment will be delievered.

I requested the person in charge to immediately refund my token amount as I cannot go ahead with a project in which cheating is involved from the very beginning. I repeat I was not informed beforehand that I will need to sign a pre-rera
form. I paid Rs. 30000 thinking that Tata Subsidary will give me a fair deal. But their paperwork shows me that things are not even planned. As I paid due to misleading/ incomplete information on your web site, I asked them to refund my token amount of Rs. 30000. But they are refusing it on the ground that the token amount is non-refundable. It is pure cheating and that too by such prestigious company.

One secret I think should be shared that is TATAs had decided over 50-60 years back to provide very cheap houses to common man by utilising huge tract of lands that was owned by them for over 100 years.However spokes were put by vested interests in Mumbai to prevent cheap houses to be made available as their vested interests were to be adversely affected.This is the precise reason that there has been enormous dealay in making the cheap houses available to the public by them and in the interregnum the prices have escalated by leaps and bound.TATA's are the biggest philanthropists of India. more  
The details as stated by you like detailed layout plan, specifications of the building materials and possession date etc are to be taken before making any payment whether it is token money or whatsoever. It is rather surprised that the payment has been made even without looking at their brochure. I am just wondering whether you have any proper receipts of the payment or no. Now even at this stage, please initiate written communication and seek details in writing and let the company start demanding what they want. After some communications, please review your plan accordingly and take appropriate action. more  
RERA is not a private arrangement or agreement to be signed by the client,it is a GOI prescribed and most States are complying with this legal requirement that freezes the liabilities,risk-sharing,etc of the two contracting sides.Further an educated person puting in his hard earnings just the callous way it has been done in this case,is a sheer negligence,can you expect the promoter of a project to withdraw the money (partly borrowed and partly contributed by those who joined a venture to acquire a flat/house) to pay you out from which source as the promoter's money is already locked in.You may be lucky if you can find a person who agrees to take up your commitment/share in the project with due legal formalities and may succeed recouping a good part of your money.Or else you have to sign all legal documents and sail with the commission, completion and allotment in the project. more  
Not expected from Tata Housing Now I will not opt for Tata Housing. in future plan. more  
The name TATA is being taken with respect, but the building construction work, if found unsuitable, the TATA group should interfere and set it right. more
