How  this  A has  copped  up  do  not  know  - Question was simple  -- whether  a  person  who  is  2nd  holder  of the  flat  in a housing  society  but  is not enrolled as  Associate  member can  attend ,participate  and  vote  in  a  general  body  meeting ? What Mr. Gaur can want to say not able to understand only A,A,A, what ? more
whether  a  2nd  holder of  the  flat  in a  housing  society can  attend and  vote  in  a  general  body  meeting who  has  not been  enrolled  as  associate  member. Whether simply by  being  2nd  or 3rd  holder in  index  II or  in  share certificate one becomes automatically  entitled  to  attend  and vote  in  general  body  meeting without  being  enrolled  as  associate  member and record  presence  in such  meetings. What is the legal position? How  his  rights are governed. (Act provisions  /case  law etc.) From: Ram C R To: gaur_sl@yahoo.com Sent: Sunday, April 24, 2016 8:27 AM Subject: Commented on a Post in [Legal Advise and Matters] more
Good step taken by CJI in the conference in Delhi of yesterday.Became sentimental. We are sure Mr Modi P.M. opens up and depute some active Minister to attend this meek and serious issues.Which is of big nature We become as Petitioner means victim of the Whims and Wishes of the Judges as they have super constitutional power and they can twist your Neck and Arm as they feel right & no body to question. Judges will tell you to go to Higher courts. and Retire persons like me who do not have sufficient resources cannot go to High Court as the cost of the Advocates and Demands fro the JUDGES IS VERY HIGH. This is we have observed. As I was wearing good clothes and with pious look on the face Judge like Mr I.M.Bohari who retired on 31st Jan 2015 at 3 PM rejected my Interim Maintenance request under Sec. E125 against my son who is not providing any financial/ support and assistance. at 2 PM on Saturday 31st Jan 2015, so that I will have to escalate the issue to High Court which with his six months (amy 2014) knowledge that I cannot afford. This is in the benefit to the respondent and u can understand the convenience of the Mutual parties. for their own benefits, leaving Petitioner at lurch. Later one Mr V.B. Phatak Judge took over in family Court Bandra Mumbai Maharashtra. who flatly refused to look into the various errors made by his predecessor Mr I.M Bohari while rejecting the Interim Maintenance application and again supporting Respondent who is having Income of Rs 4/ 5 Lacs per month besides salary of Rs140,000P.M. but not looking after father. Does any body has solutions ?? Whom to contact. Look forward for some help Hope to hear Thanks And Regards Arvind Naik Mumbai 99201820980/09322211235 more
Simply For Info. This refers to problems aired by some as lately faced in the matter of having the name (s) of designated nominee(s) / the successor (s)-in-interest duly entered on the record of the CHS. The Manual made available on the website of Lci @http://www.lawyersclubindia.com/share_files/Maharashtra-Society-Formation-Manual-9272.asp?utm_source=newsletter&utm_content=share_files&utm_medium=email&utm_campaign=nl_April is noted to provide necessary guidance, in detail, on inter alia the above mentioned area of concern. That should help in suitably having the matter proceeded with; if so necessary, with the assistance of a known reliable professional- consultant in practice within the respective jurisdiction. For the said purpose, a recent judgment of the SC dealing with the legal implications of the instrument of 'nomination', albeit wprt the West Bengal state law on CHS , if so advised, ought to be taken a special note of and kept in focus, for proceeding accordingly. more
