Co-operative Society Committee renting common plot to outsiders
Hi, I live in a co-operative housing society. Since past two years the society committee has been renting the society common plot to nearby Marriage halls which uses this open space to carry out Barat procession from our society to Marriage halls. Needless to say this arrangement is casing a lot of loud noise trouble due to bands, litter problems, parking nuisance at any odd day hours in a residential society. I tried complaining to the society president about the disturbances but no heed was paid. I would like to know if there is any legal recourse on how to stop committee using the common resource. One more thing, the area I which I live still falls under Gram Panchayat. Any assistance/suggestion will be appreciated. more
Hi Pratap Singh Chauhan, Sorry I m not agree with Mr Amit Gandhi, You need to file a complaint to Police , however give then a 15 days notice before filing the case , no advocate is required . 1 . Send one notice to society take sign from as many as society members mention that take this notice as legal notice and reply on next 15 day of receipt (send it via Speed post only) 2. After 15 days give compliant to SP (no Thana) attach that 15 days notice too and ask help from SP 2a. Thana people automatically call you (and all people who signed and gave mobile number) and that society person , you can have it settle there. max 2 month Case may be closed If you go by advocates way wait for 1 or 2 years :) Note : Take sign from house wife also , if possible complaint should be made by women will give more impact and solid. Sir,showing receipt of money out of rentals and paying taxes on such accumulated earnings are part of good citizenship. Encourage/tell every one such exists in law/before the laws comes to them. more
You can lodge the written complaints - several in numbers and get it acknowledged from the soc. Further course of action is to complaint to sub. Co-op. Registrar and Co-op. Registrar. Positively you will NOT get any response. The Open space used for commercial purpose wheren apart from Noise and other polution you can approach to local authorities. The Best source is the Police complaint - if you are ready and willing to opt for the same. more
