Compensation for damages due to strikes ( बंद)
So many strikes by different organisation are being enforced and lot of damages are resulted due to it . Business owners , shop keeper have to face losses unwillingly . If needed Strike can be held , but destructive strike is harmful and illegal . So those who called the strike has to give compensation for damages occurred . The destructive elements should be identified through Cctv footages , mobile shooting and should be penalized by law . The present condition in India is not representing healthy environment . This is not tenable. Supreme Court has ruled that bandhs and strikes are illegal. When injury arise out of an illegal act the enforcing party is liable to compensate the injury and also pay penalty to govt for the illegality. If this is not rule of the law, I don’t know what is. more

S.C. and some High Courts also confined that those initiating and organizing Parties, Associations are to compensate the losses . But, no State is implementing and EVEN THE INDIAN UNION DID NOT FORMULATE RELEVANT LAW PRESCRIBING LIMITATIONS AND RESPONSIBILITIES . Many issues have been left off by police notifying as the acts of anti-social elements and even the Governments are also giving way for an escape projecting the same reason . Requisite laws are needed to protect public and government properties , living /safe moving environment of general public life . The Losses shall be mandated to be compensated by those initiating and leading the Strikes , Bundhs , Processions even at political concern . No liberty or right is to be upheld when losses to general public or government is identified . more
