Complaint before the Consumer Forum
I have filed a consumer complaint against a builder in Noida. He has replied but not enclosed affidavit in support of the contents of the reply. Since a part of the reply is based on fabricated documents, I feel I need not to submit my evidence on affidavit to the builder's reply. The next date is posted for 13 July 2018.
1) Weather I have to ask for their affidavit on 13 July (on the date of hearing) or I can send the application now to save the time either to the consumer forum or the builder directly, which is the correct procedure?
2) Whether I also need to file an application now under S-340 CRPC for fabricating document and their reply based on that fabricated document before the forum or this application can be filed after the case is decided by the forum because if I file now the case may be delayed in the forum. more

Yes. You must insist on the OP filing the affidavit swearing into the facts mentioned in the version filed by him/her more

What you need to do is file a PETITION immediately in adequate no. of sets. In the petition, state that the documents referred to by the OP (mention the paras) are not submitted through an Affidavit, and moreover, you want to verify the authenticity of these documents. List the documents and make a Prayer to the Forum to direct the OP to submit these documents for verification of the Forum, since these have a strong bearing on the case. Also, mention that you will submit your Evidence Affidavit after verifying the documents. You may submit the PETITION immediately to save time. The court may send a copy of your PETITION to the OP for response by the next date of hearing. I am not sure, but your Petition may be listed as an IA (Interim Application) by the court and it will be given a separate number. more

In fact the builders' his reply without an affidavit is not admissible. The consumer forum should tell the respondent on the next date of hearing when you should also be present. There is also a possibility, to harass you, the builder might attached his affidavit with the reply that has gone to the office of the consumer forum while your copy may not have the annexure/enclosure. Before you form any opinion, please check with the forum office. more

Yes definitely in reply deposited in forum must be supported by affidavit. A copy given to builder needs to give u with affidavit. For more brief u may call me more

I believe what ever you have to say or submit it has to be done in the court. If the cases could be settled by exchanging the document by the parties there would be any need for the court unless parties agree to setelle the matter out side the court. more

इस देश में भ्रष्टाचार के कारण कुछ भी होने वाला नहीं है ! मोदी सरकार में भ्रष्टाचार की जड़ें और अधिक मजबूत हुयी है ! मैं भी बिल्डर और GIC HF वर्ष १९९७ में लूटा गया हूँ ! वर्ष १९९७ में मेरे द्वारा वर्ष १९९७ में लखनऊ में बिल्डर को १७००००/- और GIC HF को १६०००/- पैसा दिया गया ! मैंने GICHF से १९००००/- लों लिया था ! बिल्डर ने फ्लैट का कब्ज़ा नहीं दिया ! अब GICHF मुझसे ७२ लाख मूल तथा ब्याज के मांग रहा है !मैंने दो माह पूर्व मुख्य मंत्री , उ०प्र० के जन सुनवाई पोर्टल पर शिकायत दर्ज कराई थी ! २१ वर्ष बाद बिल्डर के विरुद्ध FIR दर्ज की गयी है ! मुझे पता है पुलिस घूस लेकर मामले को रफा दफा कर देगी ! more
