Construction and Demolition Waste Rules - Feedback Sought

Based on your feedback the whitepaper below was shared with Ministry of Environment which led to new rules for Construction and Demolition Waste Management Rules (available at the link below).

However, 4 states namely Madhya Pradesh, Maharashtra, Chandigarh and Uttarakhand did not form their state's Solid Waste Management nor their C&D waste management policy. As a result on Aug 31, 2018, the Hon'ble Supreme Court has banned construction in these 4 states.

While having a policy is just step 1, almost every state in India has failed in enforcing it. We would like to now seek your inputs on what have you observed in your state in regards to enforcement of these rules. How are these rules being followed or not followed? Are the local municipal corporations enforcing these rules in your city?

I am heading company engaged in central zone of Delhi for waste management. The feedback is as follows : 1. The whole mission is failing in achieving its objective as the guidelines and rules assume it is a similar problem and similar solutions every where in the concession area. Assume and know that Delhi is 30% suburban, 30% slums and the approaches/gullies/nallahs/sewage system and residents there or even commercial activity being carried out do not allow or contribute to waste management activity. 2. ULBs are designed and commissioned with infrastructure and manpower /systems/procedures/tools & tackles/technology to carry out/(not carry out) any activity intended more than 30% at best. 3. Punishing concessionaire all the time in not achieving the noble targets and system ensuring reading between teh lines to penalise on each and every activity as per PIM which are officially called guidelines but enforced as doctrine in a totalitarian state makes project unviable and doomed. 4. Coming to C & D, those making guidelines, rules, byelaws dont realise it is C & D waste to be segregated and empahsis should shift as 20% of Delhi is dug up, reerected every year contributing to unimaginable, unmonitored, unassessable amounts of C & D waste which is dumped by innovative means during the night (when nobody can monitor ) next to dhalaos or even open dumping place. All this is mixing up with normal MSW and making it unusable either in compost of waste to energy plant. There is not a single challan issued in last 2 years which shows how system is led to fail by those enforcing /unenforcing the laws. 5 Believe me we are the best segregators in the world as far as recyclables are concerned and all emphasis given to segregation of plastic or paper or metal is bogie and emphasis should shift to controlling generation or dumping of C & D waste. There are many types of wastes around us. To deal with it we must have to provide basic knowledges to our childrens in school. Children's are lacking basic education in schools. There's a teacher nearby by house. Who is from Bihar. He's so discasting. He's the worst guy in the history of my life. Im wondering what would the children if the Guru is such a shameless idiot. more  
Debris not removed for months together and no responsible authority take action.Its understood their hands might be greased. more  
wonder why the ban could not come from the state authorities, are they so helpless ? Courts cannot be doing policing for the state, they have better jobs to do. more
