Consumer Courts
Judges should be consumer friendly and not feel biased if the consumer is representing himself .Moreover their rulings should be straight on goods found defective and repeated complaintsso justice is carried out.When the forum was formed they were supposed to decide the cases within 90 days BUT nowadays the cases are lingered on for years and dates given are more than six months etc.,which is very wrong and should be decided in a confined time limit. more

Cases in the consumer forums are decided on the face of the party in litigation. 'You show me the face, and I will show you the ruling', is generally the guiding adage in the consumer forums. At least in the District Forums and State Commission, no advocates from either side should be allowed. From the Opposite side only the dealing persons from the company may attend the hearings. In consumer forums, the first action should be 'decide the issue/s' in the complaint. Then, proceed for production of the evidence and so on and so forth. I have experienced how the Presiding Member of the NCDRC lay the guidelines for other members on how to delay cases, and how to decide against the complainant. One of the Presiding Memberes of NCDRC in the past laid down that with the VAT coming into force in there was no need of early hearing and that there would be no such issue of overcharging. Refused to place the complaint before the larger bench. And, the case lingered for nearly 13 years with a decision against the complainant in a class complaint. It all depends upon the Judicial Members of the consumer forums to decide how to direct the proceedings. I do not know how to solve the issue in the light of the fact that the Members are mostly appointed on the political influences. more

The consumer forums should list reasons and sub cona to file and decide on merits.There is no point making the complainant come again and again and spend more money on the case filing and appearing for endless dates.Even if the respondent is declared X partte ,he is always accepted by filing a appeal with some make believe story. more

I filed 1 complain in District forum, Takes 3 yr to get verdict. Infrastructure is very bed in district forum. more

Sir Ji It is all NEXUS which is called 'SETTING' even in Funeral Ghat ( SAMSANGHAT) if you don't have Setting then you when you will be given DAMP wood or wet wood where your body will not burn so when you die before that tell your family or give your family extra money for DRY WOOD AND FOR SETTING,when you file any complaint in consumer court then the game starts and also the setting starts from all sides the Complainant gets tired of hearings and adjournments that he regretfully stops. more

The right of the Consumer treated by some judges are a waste of time and thus it becomes an issue and in Deliberation they delay the cases to such an extent that the Complainant gets tired of hearings and adjournments that he regretfully stops .Also Note if the complainant is delayed he is not given any consideration but if the respondent is delayed or does not appear the complainant is told to wait even after the third call.

As the Presidents of the Consumer Forum are appointed from either the serving judge or the retired judge, the mindset continues even in the consumer forum. The entry of the advocates should be allowed from the side of the company in case where the case of the consumer is being represented by the consumer himself. Timelines specified in the Act should be followed. The courts also require adequate infrastructure which need to be looked into by the Government. more

Sorry to state I tried my utter level to file a case in the Supreme court against a biased order passed by the National Commission but to my surprise I was told that only Lawyers registered in the Supreme Court can be file the case.Also I approached the free legal cells but they also diverted me to the lawyers.Now imagine for a compensation of Rs.75000/-the court expects me to file a case paying 50000/- plus other expenses plus visit on hearing dates,Not possible this is our legal SYSTEM.aLSO NOTEWORTHY TO NOTE i APPROACHED THE mINISITER OF CONSUMER aFFAIRS sH.rAM VILAS pASWAN AND WRTE THEM ON HIS E MAIL AND SENT TWO SPEEDPOST LETTERS BUT i NEVER EVEN GOT AN ACKNOWLEDGEMENT FROM HIM OR HIS OFFICE. more

Sir, I really admire your wish. In fact the ideal situation cannot be there and this is true irrespective of whether consumer cases or civil cases or criminal cases. The companies try to gain unethically whatever means available and there be a mechanism available to get redressal by the weaker party in the disputes. more

aCT IS NOT DEFINED IN PROPER AT ALL.a dISTRICT FORUM JUDGE IF DECIDES A CASE IN YOUR FAVOR BUT THE RESPONDENTS DRAG THE CASE TO THE NATIONAL COMMISSION AND THERE THE JUDGE OVERULES THE ORDER OF THE PREVIOUS JUDGES BECAUSE HE IS ONLY INFLUENCE BY THE PRESENCE OF THE BATTERY OF LAWYERS APPROACHING HIM.
