CONSUMER PROTECTION ACT OR CONSUMER FORUM

I was admitted in the FORTIS Hospital, Noida during April 21 till 7th May 2016, due to severe meningitis and acute brain fever. Also, I had a health Insurance Policy running with MAX BUPA.
After I was discharged from the hospital, I put the claim paper along with all the relevant documents and Invoices, and submitted them to the designated office of the Insurer M/s MAX BUPA. After so many verifications and personal/e-mail discussions, they had finally rejected my genuine health Insurance claim on the pretext "PRE-EXISTING DISEASE NOT COMMUNICATED".
Now, I have decided to file my case with the Consumer Forum and for which I need to know if there is some CF advocate who can handle the matter. more

You do need an advocate for consumer cases. You can go argue yourself as a party in person. IT will be efficacious, economical and speedy. I have done it-1o cases and I have argued nd won all the ten more  
I am a mechanical engineer, but I have been pleading my Consumer Cases myself since over a decade now. 6 cases were settled out of court even before filing the cases.I won 6 cases in the Forum and lost 4 cases but I won all these 4 cases on Appeal in the State Commission. 4 more cases of Appeal in the State Commission is continuing. All 4 have been admitted. As of now, my success rate is 80%! I hope to win all these 4 Appeal cases. In that case, my success rate would jump to 100%!! I always encourage educated people to fight all cases themselves; not only for the economy but also to prevent any mischievous acts / underhand dealings by the advocates with the Opposite Parties. I have had very bad experience with the treachery of some advocates. In a civil suit, one advocate entered into an unholy alliance with the O.P. and did not attend 3 consecutive hearings and hence the order was passed against me and I lost Rs 15 lakhs by now in terms of capital lost and interest thereon. In another gratuity case, the advocate did not attend 3 consecutive hearings in the Appeal case in the higher court and the order was passed against me even though I had pleaded the case myself in the lower court and won it. I lost Rs 45, 000/- claim of interest on delayed payment of gratuity. It is difficult to prove the treachery of such people.Best is to do away with the advocates! more

I hear there is a Supreme Court Order that utilities like water and electricity cannot be cut by the supplier without giving adequate notice.Can you please help me to get this? I contacted many people.But in vain. I need this info rather urgently. Thanks. more  
As per my knowledge when Health or Mediclaim Insurance is taken most Insurance Companies send only Policy Schedule and not the Policy document containing Terms and Conditions of Policy. If your case is also such, you can file a Consumer Complaint in Consumer Court of your City. Please rely on the the Judgement of Hon. Supreme Court reported at- AIR 2000 SC 2014. You can say that Policy Terms were not known to you and therefore Insurance Company can not rely upon those Terms which were never disclosed to me. more  
As your meningitis was not preexisting, you need to see a good Neurophysician who can put it in writing that this was not due to any preexisting illness, then file your case. Take advice from a good lawyer only once you have a report, but file your papers in consumer court ASAP and then look for the legal literature, go through and as a CA you will be able to understand. Tell your lawyer that his fees will be paid by the insurer if they loose.I can suggest a lawyer only if you write to me rsck19@gmail.com more  
I think your case is justified. You can file an application in the instant case yourself without any assistance of an advocate. The rules and acts has been made simple specially keeping in mind that consumers can themselves file the complaint. Get a book on Consumer forum with Act and comments, go through and file the complaint with evidences. It is as simple as thart more
