CORRUPTION IN JUDICIARY
1. Only a competent person with great value and character must be allowed to be a judge. This means there must be an open system of evaluation of a person before he / she is made a judge.
2. There should be a system where in the litigants can submit complaints if any without the fear of contempt of court proceedings. There should be a real scrutiny of the judgements meted by judges by an impartial forum who are not only judicial luminaries but also man of character and great human values.
3. Any judgements if found not proper must be ticked off against the judge. And depending on seriousness of the miscarriage of judgement the responsible judge should be black listed and removed from any further judgement. Corrective steps to correct miscarriage of the judgement must be initiated.
4. There should be defined time bound parameters for completion of a case from the instance the case is admitted by the court for proceedings. Any digression from the time bound completion of judgement must be questioned and taken negatively on the respective judge or the forum. Corrective measures to be taken so that this type of deviation from time frame of completion final judgement does not occur in future.
5. All Judges at all levels have to be made accountable regarding the judgements they deliver or the manner they keep postponing the judgements and also digression from standard time frame of completion of final judgement.
6. It is an open secret that many judges accept different types of benefits either in cash or in kind to work in favour of the party offering such incentives to them. This happens in terms of deliberate delaying of the proceedings, bringing up irrelevant parameters, giving contradictory judgements, undue favourable judgement for the favoured party, pronouncing one good and fair judgement as a camouflage to shield the deliberate compromise the judge has made in ignoring or compromising other due judgements in the case.
7. Callous and insensitive nature in handling the proceedings. Open threat in the court to browbeat the litigant who is not in favour.
8. Asking verbally a litigant to comply with certain direction of the judge with an intention to put a particular litigant in a disadvantageous position but not keeping a record of the direction given.
9. Judges must be given an attractive remuneration, parks and facilities so that they are comfortable to lead a fairly decent life style.
10. Judges should retire only after attaining age of 65 years. They should be given good retirement benefits including pension.
11. After retirement or after quitting the job prematurely, Judges should not be allowed to take up an office of profit with remuneration or honorarium etc from any Government or semi Government agencies.
12. Judges should be provided security based on merit of threat perception.
13. Judges have to understand that they are human beings like all others. Hence they have to follow the basic human code of conduct. They should not show disrespect or over lordship on litigants and witnesses. more
