Courts in Delhi - Key Issues

Dear all:

With this pose we would like to seek your inputs with the key issues you have observed/experienced at courts in Delhi.

Please list them all. Once we know them we will review Root Causes and work on Solutions separately and share a whitepaper with CM and leadership team.

The objective would be to initiate actions that will make courts more transparent and citizen friendly.

My personal experience, you need to pay hefty amount to advocates to turn court's decision in favour of you. Whether it is wrong or right, it doesn't matter. Decision is not as per the case but as the experience of advocate to handle such cases. We need proper fees structure (which is like impossible), need a independent agency whom if anyone contact, will advice what can improve to close your case. We need 1 more independent agency who can check, what cases are unnecessarily dragging. Sorry to say but our courts are indirectly encouraging crime in India as after 1 case, culprit understands that its not a big deal to have a case on you! We need serious attempt to get this mess cleared. The only problem is, our advocates would not like to get this straighten up. But important is, something should be started. Everyone know that justice is on sale. Pay and evade from justice. Unscrupulous element are mostly engaged in such activities. there is lot of middle man from all sides. They fix the rates , money is paid and decision will be in your favour. Poor people are mostly victim of such decision. In modern time might is right is prevalent. In the Government, everyone is not honest. People are at the mercy of the Government. Lay man can receive the subsidy but cannot get justice. Government must create such atmosphere, where the law should be more stern and the employee should have fear of act in mind like in foreign country. Ram Yadav (senior citizen) more  
There will be no. of irrelevant court cases going on in the indian courts by which number of innocents are being suffered as justice is only for rich in present system.All the court cases should be computerized & justice should be given to these innocent people. more  
cases represented by state (PP) are definite source to deny justice to the complainant, where PP in one case changes very often, they don't have time to see the file even on the date of hearing, no coordination with complainant, judges do not listen to complainant, no provision to get legal aid for the cases being represented by state, even appeal cannot be filed by the complainant and can be filed only by the PP who have no interest at all as they loose nothing. All these loopholes favors the criminals as they get acquitted because of weakest opposition/cross examination and faulty system where state has many faces (PP) and no one is responsible for the injustice delivered. more  
The main reason for delay in getting justice is not because of the shortage of judges but the procedures . The long procedures of making issues, admit / deny of documents,evidence and cross of plaintiff /defendants, miscellaneous applications etc etc etc......The judges are not able to see the documents and decide the matter early.For early justice the documents filed should be signed by the parties and their council and the judge should be able to pass an order immediately after seeing the documents and hearing arguments. There should be a harsh punishment for filing false documents. Also a time frame of maximum one year should be set for judges to give judgement. more
