Courts in Delhi – Key Issues

1. Working of the courts is non-transparent
2. Judgements differ from what was concluded during arguments
3. Non-availability of Government lawyers
4. Expenses involved in engaging private lawyers are very steep
5. Cases get dragged for years
6. Too many adjournments in the courts
7. In consumer courts, the judges don’t reach on time
8. Courts are insisting to file cases in English whereas most of the litigants do not know English and they don’t even understand what’s going on in their case
9. FIRs are written in Hindi and the litigants are asked to get it translated into English thus imposing cost and time on the litigants
10. Rejection of documents is done based on frivolous grounds
11. There is major corruption within court premises more

There is no point in making this subject Modi vs Kejriwal as none of them is responsible for this pathetic system of justice.All the stakeholders i.e. court employees, lawyers and people of other services, are interested in lingering on the cases. As with other systems, this system has also failed to fulfill the aspirations of the people. As far as govt. is concerned, whether Delhi,central or any other, They can reduce the burdens of the courts by reviewing all the govt. cases. Those which have become useless over a period of time should be withdrawn and in other cases negotiations should be initiated to settle the matter out of the court. Another way out is to seperate all the govt cases from the judicial system and try to settle them through retired judges. This will reduce the burden of the courts substantially. One more thing which I would like to point out is the quality of govt. lawyers. It is pathetic which causes govt to lose cases in lower courts and therefore appeals and lingering of cases. more  
JUDGEMENT IS PENDING MORE THAN A YEAR, WITH NO ANSWER AND NO TIME TO MAKE IT. more  
I am not sure if this comes under Delhi GOvt jurisdiction. If yes, than: 1. Reduce the no of cases for and against Delhi govt thru out of court settlement. 2. Make all court areas technology friendly in terms of video and audio recording of all court proceedings, all cases be digitized, summons be sent on emails, large screens for display , especially when there is rush for major cases, BUT Dont discourage HINDI or manual work for uneducated litigants. 3. Try and encourage self representation of cases, as done in consumer courts. SO that people have easy access. At the moment the nexus in all profession, LAWYER-JUDGE, DOCTOR-Hospital, etc is a major hurdle in access to free and fair litigation to masses. 4. Ask the legal dept of all dept in Delhi Govt to ensure that the litigation is last resort and there should be provision to settle the issues with the dept head and concerned company or person. 5. All court premises should have easy public transport access. 6. All basic service like Stamp paper, notarization , challan deposit should be done thru a small help kiosk, electronically, as multiple vendors still charges extra money for small denomination stamp paper etc. 7. Once a major portion of back log is mutually settled. Courts can simultaneously set a time limit for each case to get verdict. SAY TWO years. This will discourage lawyers habit of taking DATES!!. 8. I am not sure if LAWYER- JUDGE -POLICE- MCD nexus can be broken. As all concerned, Like POLICE, people associated with COURTS would tell, how to FIX a BAIL or anything and everything for a FEES. Most of time only when you go from Lower to higher court, you find less evil OR more EXPENSE to be done. By reducing litigation, we can reduce this nexus. 9. There are lot of commercial disputes involving money settlement and property settlement. If this can be fast tracked , lot of financial activity will also start. 10. Please put all posting of this Dept on NET. My last suggestion to AAP govt is , please start all transparency in the dept of your working, like each dept and each person employed should be listed in Website with his / her DATE of POSTING, and also agains each staff his full history of posting as on DATE. this will enable people to be aware about how and who is getting posting of his choice. more  
Cases drag on in courts because of lengthy procedures . If the procedures are simple cases can be decided early. Judgements should be given only on the basis of written statement written evidence filed and arguments. more  
ONE MAJOR SUGGESTION I WOULD LIKE TO GIVE : - I HAVE SEEN THAT ONE COMPANY HAS SEVERAL CASES AGAINST IT IN VARIOUS COURTS OF DELHI,,, ALL ALMOST SAME ISSUES.. WHY CANT THESE BE LINKED AND HEARD AT ONE PLACE / ONE COURT, A HIGH LEVEL JUDGE. THIS WOULD SAVE HUGE AMOUNT OF TIME AND EXPEDITE ALL PROCEEDINGS more
