Deficiency of services from Housefull

We purchased Storages, Bed, Wardrobe, Book Shelf and Shoe rack from Housefull furniture in March and April 2016. As soon as the monsoon started all this furniture was started producing a layer of Mildew fungus. I registered complaint with Housefull customer care team on 18th July and they promised to get the furniture polished. On 21st July, one of the technician visited with the bottle of thinner (Turpentine) and cleaned the surfaces of 2 items leaving other furniture as it is. He confirmed that the fungus will not form again on the furniture. By 23rd July, the fungus was back. When contacted, the customer care promised to send someone immediately to take care of the fungus issue on all the furniture. From that day, till today, there were only promises, but no one visited to polish the furniture yet. The fungus has engulfed the furniture from inside out and we had to wash all the cloths twice and now we can't keep anything inside the wardrobe or storage now. Even after repeated complaints, what we were getting are the dates to resolve the issue.

Now, the mildew (fungus) has grown so much, that even opening or closing the door also dusts white powder in air. I was down with cough and sore throat for a few days due to allergic infection and my younger daughter is constantly sneezing and coughing for a week now. This has started taking a toll on our health.

Apart from this, the bed we purchased was broken twice and now all the sleeping planks are bent. I gave them the option of replacement with a higher end model, where I was ready to bear the difference. The customer care representative plainly denied it by saying they don't have the policy to do that but agreed to change the 4 bent planks. Till the date I am waiting for it.

Can anyone guide me on how can I raise a complaint against this company in any forum where I can get justice or how can I file a suit in a Consumer court?

Kiran Tandel: First & foremost are you have the original bill & the proof of payment made ? Then go through the terms & conditions of sale to see whether there are any safety clauses in favour of the seller (Merchant). Also, see whether the warranty / guarantee clause is mentioned. In the absence of any of these clauses, it is taken that the standard clauses apply for the sale. Since you have raised the issue within a period of 5 months from the date of purchase in all probability you have the right to get them replaced. If however the Company (seller) does not respond within a reasonable period (say 15 days from the date of your notice ) you have the option of proceeding against the seller in a jurisdictional Consumer Court (in terms of the Consumer Protection Act, 1986). However, you have to enclose COPIES of all bills, receipts supporting the sale/purchase in support of your claim. List out the deficiencies in chronological order & & quote the dates on which you have raised complaints/service requests with the seller & the replies given by them from time to time. You may approach the Consumer Court directly but if you are not conversant with the practices in a Consumer Court you may engage the services of a good Lawyer in enabling you to draft a suitable complaint with the Forum. Please note to claim full replacement of all the items besides compensation for the loss suffered by the members of your family both physical & monetary loss. I take this opportunity to wish you good luck in your endeavour in solving the issue at the earliest without further mental and physical strain. more  
Send them notice to replace of goods, if not done you may approach consumer court. more  
You do whatever you feel legally, but to stop deterioration and spoil your important things, please arrange pest control immediately. more  
Issue a Regd. notice to the supplier stating the deficiencies and give 15 days time for taking action for rectification of the deficiencies. If no response is received, you can go to consumer court. more  
In response to Ms Kiran Tandel, I w'd say that visit their shop with a person who can argue with them and threaten them to take legal action against the shop and also to expose the deficiencies in services through press and social media. Give them ultimatum with a time limit after that highlight their behaviour and attitude in the social media like Twitter, Facebook etc. After all this fails lodge a case with the district consumer reddresal forum submitting all proof to establish authenticity of your claims. You may seek advice from a senior lawyer who works for such cases. Unless You make a loud noise with firm protest and attract attention of their prospective clients, They will not listen. more
