Delay in handing over apartment

Can someone advise me if I can lodge a complaint in RERA against a builder who has applied for RERA license but has not been approved yet.

I have bought a apartment in Bangalore and the same is delayed since Mar 2016.

I have written an email to RERA but there is no reply from them. I am paying rental plus EMI and need to travel to Bangalore every weekend to follow up with the builder. Feeling quite helpless. more  

Yes. Apart from RERA you can also opt for Consumer Commission/Forum, Civil remedies- over and above. more

I do not understand how you are paying both, the rentals and EMI. Rentals are paid for the property you have taken on rent, and that means it is a completed flat fit for living in or doing the purpose for which it has been let out and that the flat/building does not belong to you. EMI is paid for a flat/building/property that you have purchased on payment in installments, including the interest. If the building is complete and the builder is holding the completion certificate from the appropriate Authority, then only you can take over the possession together with a completion certificate. It is only after taking over the possession that the incidence of paying any taxes, including property tax, only from the date the possession is taken. If the building is incomplete as per the booking terms, you can file a complaint under RERA with the Regulator. Or, under Consumer Protection Act 1986 with the appropriate consumer forum. I do not know if the State Government has made the required Rules and appointed a Regulator under RERA. e more  
Unless builder is registered with RERA, the penalties may be difficult to impose. Send complaint by registered letter to both Consumer Affairs Dept of Govt of Karnataka & RERA urgently independently. more
