Delhi State Consumer Court Judgement

Hello Everyone,
I booked a flat in Noida and paid 2 installments for it (approx 9 Lac) in 2011. 1.5 years back builder said that the project has been cancelled. When I asked for refund+interest, the builder said that they will refund only half of what I have paid.

So, I approached Delhi (since builder’s registered office is in Delhi) and Noida police many times, but they are not doing anything.

So, I approached State consumer court and prayed for flat at same rates of 2011 or refund my money+interest+compensation.
After 2 months of wait, my case got listed yesterday and the Judge said that since the amount paid is less than 20Lac, so the case cannot be heard here and advised to go to District consumer forum.

Can anyone please suggest whether this judgment is correct. The total cost of the flat was around 46Lac.
Can I approach the consumer forum again with same complaint number or I should now file my case in District forum.

finding corruption patriot with false hopes can be only impotent ones who are gud 4 nothing. They allow us and sit back n see. 100% eradication no one vouches but keeping it to the minimal is ideal. more  
corruption patriot? hey mr. ahuja stop giving people false hopes. corruption will never be wiped out in india. and ms poonam let me help you out here. as per my experience you won't see a dime of your money back. the builder can just wind up his company and thats it its over. his paid up all he can adjust. you are in india dont forget. and dont lie to yourself with more hope. and waste more of your time and ebergy on this. if 9 lacs is not much just give it up. i lost almost 2 crores when i was in india. after chasing for 2 years i finally gave up. you can goto police claim cheating and nothing is gonna happen. because its all legit on paper. even if the builder is arrested he will get bail then the case can delay for years. you got conned. now get over it fast and start moving forward with your life. dont fall for politicians words. coruption will never end in india. even modi may look clean now but few years from now some scandal some corruption case will come out with modi's name on it. the sooner you realise it the better for you and next time be smart if something sounds too good to be true it probably is. the court system in india is a joke they have millions of pending cases when do you think your number will come up? more  
I agree with Mr.Anand Mohan. Inspite of specific provisions in law and also confirmed by many apex court judgements, the consumer forums follow the civil courts procedure. This was never the intention of the consumer protection act. However, speedy redressal can be got at the consumer forums. more  
The state commission is an appellate authority for claims below 20 lacs not a first stage forum to try the case. You cannot approach it directly by jumping the que. You have to first go to the district forum and in case not satisfied with its judgement, you can file an appeal in the state commission. I think in your case they must have not even admitted your complaint. In fact you have wasted your time by filing it there. Please approach the district forum. more
