Directives of Constitution, Chapters of IPC getting diluted

Since General Elections fast approaching, Chapter VIII, Offences relating to public Tranquility Section 143 to 160 ; Basic Directive of Rule article 14, 15, 25, 26 and , 44, 45 and 46 . more

Caste and Caste/Race based Communities are within their Religious Custom, Practice and shall be left to those Religions which were addressed separately in part III of the Constitution. In all other matters , issues , Caste, Race and Communities shall not be entertained by the Governments whosoever Rule except S.C./S.T. of Scheduled and Forest Areas . Castes and Casticism is anti National as confined by Dr. Ambedkar in the Constituent Assembly in 1949 AND IS NECESSARY TO ERADICATE IN THE RULE UNDER INDIAN CONSTITUTION . more
A.”Whoever, with deliberate and malicious intention of outraging the religious feelings of any class of the citizens of India, by words, either spoken or written or by visible representations, insults or attempts to insult the religion or the beliefs of that class shall be punished with imprisonment “ under Section 295 -A. B.”It is no defence to a prosecution under S.298 that religious feelings were deliberately shocked or wounded by the accused in order to draw attention to some matter in need of reform. Under S.295-A , it would be a good defence to say “I had no malicious intention towards a class, but I did intend to would and shock the feelings of an individual, so that attention might, however rudely, be called to a reform which I had in view” AND ESCAPE . C. “... It was held that the act of the accused would amount to an offence under this section [Sec.295] , if the idol could not be touched by any one except the priests and if the object of the accused in performing the ritual was to ridicule openly the established custom” . Sacred Objects: “An idol of a Hindu God is a sacred object and it is worshipped. A tomb of a Mohammedan Saint is an object of veneration” . THESE A, B, C illustrations of IPC clarifies the real status of Offences including defiling relating to Religion and, the differences set BETWEEN “ Class of persons of one Religion insulting any other class of other Religion “ AND ‘ Any person of One Religion insulting with deliberate intention of shocking or wounding the religious feelings of any other person ‘ LEADING THE WHOLE ISSUE OF MALICE EXEMPTED/LEFT OUT IF THE CONTINUED ACTS DECADES TOGETHER ARE TAKEN INTO ACCOUNT. D. Promoting Enmity between Classes under Section 153 A of IPC specifies “ The essence of the offence defined in the Section is malicious intention” . But, many getting escaped , and many issues are not being considered as out of malicious intention . The clashes , rivalry , unrest in the society between Castes, Communities also creating between Religions and , the Religious Belief and Custom. The repeat incidents decades together need to be understood as will full , intentional and with malafied intentions AND THERE IS FAST NEED TO REDRESS AND REFORM suitably . Peace, Pleasantness, Safety and secured fraternity will be possible when these issues are reset for a better Social Life lead with committed/realized responsibility . more
When Rule of law do not prefer or set means of Castes , Communities and Religions for Economic Benefit , such malafied issues with set Political interest do not arise. This is why the Constitution did not prefer any Caste other than Scheduled Castes and Scheduled Tribes who shall be organized with continued assistance and safeguards under the Rule. Secondly under basic concept of Uniform Civil Laws, Constitution mandated restriction/set a ban any refusal of any Citizen of any caste, religion, race and gender for admission into any Educational institution of any Religion where Government invested or provided Funds for that institution . While the Constitution permitted any particular religion to organize educational institutions for the children of that particular Religion . But, political concepts of congress and their supported allies went on going against Constitutionally set mandates . more
We didn't have this polarization about 5 decades back . Because in schools and colleges we never knew which caste the neighbour was in the class room. When the reservation system came one section was happy resulting in the other disappointed . This has become a regular never ending race . I think it has become more active with vigilantism groups taking over . Government can try solve this problem and pasify both groups . Otherwise there will be another invasion from outside and we will never have a Gandhi to bail us out . more
Correct conclusion that needs attention of Governing Bodies of our Constitution, more particularly, the S.C. to Regulate Constitutionally bound Rule and carry. more
