Section 375 of IPC, out of seven descriptions given, the circumstance of RAPE includes sexual intercourse performed on a girl with or without her consent, when she is under 18 years of age. more

By mistake it is posted as a resource Mr. Biswas, actually it is a continuation to some discussion going on the subject of RAPE at that time of my posting. more  
The Basic foundation well defined is "Against the consent". All other explanations are subjective. more  
1. Law also defined & confined that a boy under the age of 14 is deemed to be incapable of committing a rape and hence no prosecution for rape is possible against him . And , the Indian Law exempted the Boys of 14 and 15 also in the Law enacted as " Nirbhaya/ Abhaya " Act even recently confining to 16 to Punish for Rape and is in deed against the Naturally Human , Scientifically valid issue of capability in giving the Birth while at Sexual Intercourse whether called as Sexual intercourse or Rape . 2. Laws are written down for Safety and Security of life and livelihood . Therefore , the Law is to be at Birth Giving Potentiality / Capability with the possessed Hormone development , 3. The Natural Human Potentiality due to inhidden Fertail Sexual Hormones that brings-in capability of Birth Giving capacity that starts from 11/12 in Female and , 13/14th year in Male which naturally inspires and exits Sexual Desire shall be the base added with the Health & Hygiene of the Female AND THE SEXUAL INTERCOURSE BETWEEN THE WIFE AND HUSBAND OF THIS NATURAL AND SCIENTIFIC CAPABILITIES ARE TO BE REGARDED FOR A JUSTIFIED RUN OF FAMILY IN INDIA . 4. If the below quoted recognition in the field of Law & Justice is true ; " The unlawful Sexual intercourse is such that it destroys a woman' s supreme honour . Ever since the rape of Proserpine, it has always been regarded as an offence of great heinousness and as such deriving even the sentence of death. The offence owes its enormity to the defilement and dishonour it reflects on the whole family for if men prize any thing above all others it is the honour of their women and their forcible ravishment naturally stirs up all those feelings of retaliation and revenge which have accounted for so much blood-shed in history . Sexual intercourse is necessary for the welfare and perpetuation of society . Marriage is the legally recognised method for sexual satisfaction between man and woman . " THE HONOUR OF FAMILY SHALL NOT BE RUINED AND CHALLENGED EXEMPTING THE " Consent of Women " as relaxed in English law . AND , the dangerous issue of " so much bood-shed in history " besides the fact of Murdering/Killing the person the wife had given consent for unlawful sex in some cases and , killing the Wife so Consented under Adultery . Law and Fear of Law cannot bring and set honour to the Husband and Family of those Consented illegally/unlawfully and is morally and naturally true in those who cares much for Heritage , Culture and Safety in Practicing the Secured tie-ups 5. This is why , law is different and the justice is different in the issues of Natural , Moral and ethical values of Human beings that really demands recognition to Morality , Human Necessities of age and the Scientifically Potential Fertility of Birth Giving and not the age opted/imbibed by others and even rulers since this issue certainly Moral , Natural , Decent and at Goodness under Humanity and Natural necessities of Hormones that inspires and provokes for Sexual Intercourse . In this connection , the legal recognition of Sexual Intercourse " The Law regards sexual intercourse as the normal exercise of physical body " IS SUCH STANDING AS THE EVIL OF ADULTERY AND EVEN RAPE WITH CONSENT and thus is not Moral , Natural , Decent and an act at Goodness if it is not within the Wife and Husband . Justice shall be Justified and Law should upheld the justice with the inevitable qualities of Moral , Natural , Decent and Goodness please . more  
Exactly the spirit and objective of Freedom Fighters is not for such laws and Rule requiring Unity like in QUIT INDIA MOVEMENT at national interest from all sectors . more  
That is the fate of our legal system sir! Drastic changes are to be made in various criminal Acts. The good old Acts have become definitely outdated.
Take for instance, let us take a comparitive look pre and post 1990 periods,
due to increase in communication technology, visual media has assumed a palm top form. a small press of a button will take us to a world ride with in no time. Youngsters have become too addicted to this kind of media and are able to watch all porn sites which can be attributed to their teen age and the parents, who are supposed to monitor their lads are busy rather negligent and we can see the effects.

Now coming to the point, these prematured so called teenagers are involving in such henious activities, the outcomes are everyday read in news paper and watches in channels. The term MENS REA has special mentioning here.

How can the courts Excuse such evil intent in so called minors ? Will that excuse not create a silly idea among those agers and make them think that inspite of commiting crime they can be just sent to juvennile and acquitted later?

Lot of research has to be taken in this area and our criminal Acts are to be updated accordingly. more  
Marriage of a girl below 18 is illegal. Sex, including with mutual consent, with girls below 18 is illegal. So there should be no question of sex with married wife below 18 year being legally allowed. What needs to be done that each and every PANCHAYAT / local authorities be held responsible, along with the parents for any violation of such a marriage. more  
1. The meaning of Rape was confined differently in different cases . 2. Sexual intercourse of a Couple is the Conjugal right at Justice . 3. Sexual intercourse other than within the couple , it means , between others is unlawful Sex punishable who ever he/she may be . 4. Sexual intercourse between a married and un married as well as between a Married Male/Female with another' s Wife/Husband also is unlawful Sex punishable . 5. Rape is such that it shall have the marks of cruelty and force while in intercourse with any body whether relative or not whether other's wife/husband Cruel and wicked intercourse also included in the purview of Rape . 6. IT IS STILL TRUE AND COGNIZANT FACT THAT " A question that has often been raised but not yet categorically answered is whether it is actually possible for a man to rape a woman unassisted . " WHICH ALSO NEEDS UNDEVIATED AND JUSTIFIED CONCLUSION and if derived , falls strictly within the meaning of above point 5. 7. The issue of " Consent of Women " that exempts the outsider from unlawful Sexual intercourse to be punished at 10 years imprisonment is in deed anti-social and unjustified in terms of the Holy and true meaning Conjugation and Conjugal rights and , the meaning of Debauching and Adultery . BUT STILL , THE LAW IS COMPELLING THE HUSBANDS TO SUFFER FROM DIGNITY , PRESTIGE , TRANQUILITY AND LIVE FAR FROM SANCTITY losing all Rites just for the maladjustment concluded to protect those identified in IPC 376 A to D . 8. Whether or not Justified , law is to be bound by all until the Full Bench of Supreme Court pas verdict under Humanity , Morality , Justice and Decency . 9. Sworning the Morality and Humanity binding the ancient practice of Safe , Secured and Morally bound responsibility , there was the practice of conducting marriage at the maturing time of the Male and Female which did not lead them to suffer with the tampering Sexual Desires years together . In fact , the Female from 11/12 and the Male from 13/14th year of age get sudden Sexual Desires due to fertility of sexual Hormones which is quite Natural in Human Beings that no Government law can lock / curtail ; the Rules of Government punishing the Care Takers with imprisonment restricting marriage is making both the Male suffer or go for touch for 7 to 8 years while the Female to suffer or incline for touch for 6 to 7 years Even then , the Society was good at heritage , culture and morality norms and since after 1995 , as the Teens had to be away from such atmospheres of observation within the Family circles , the issues of T.V. together with the already existing Eve Teasing and Criminal Ragging since last TWO decades lead to drastic changes in the Towns particularly the Cities with the added Pub Culture , Lovers Day , Holiday Events and the recent Kiss of Love amidst the abundant Liquor and Drugs besides the exiting T.V. Visualizations . The unemployment and and lack of earning opportunities made a majority of Children and Youth work in support of Political Organisations and also work for anti-social Teams and Troops as already known to the learned public . more
