Distt Consumer courts juridictions
I am resident of mohali(punjab) and i have to file a consumer court case against reliance info in mohali disst court. Mohali Distt court have refused to accept my case as my opposite parties are not part of punjab.
So looking for legal advice that is it mandatory that opposite party should belong to same disst\state? more

So from all comments i understand that i have to file a case in mohali consumer form by adding a mohali reliance outlet as a party. On this i have some questions 1) Will the opposite party(local mohali) will be impacted by filing this suite or reliance head office will fight case on their behalf? 2) Where can i file RTI for this? i mean i am not able to see any RTI information on disst consumer forums website. So who should be PIO in this case? 3) I didn't have any communication with reliance local agent. All communications were on email or on phone calls. more

I don't think it is necessary to file RTI for knowing Jurisdiction of a consumer court. Consumer Protection Act is freely available on internet. Please download the same and read Para 11: 'Jurisdiction of District forum' . Hopefully, that would clarify your doubts. more

The Consumer Affairs Ministry, GOI is not working properly. Registered Letters sent to Paswan, Minister and Secretary are not even acknowledged what to talk about action taken. Yes its necessary that opposite party must be from the place where suit is brought. You can name a local head office of the company as dependent in addition to the the outstation person and since reliance has its head office in Mumbai so make its head office party too. Complainant can file a case in a different Dist. Forum within the State or a Dist. Forum in another State on genuine reasons [Medical Grounds, Inaccessible from the Residence due to long Distance etc.] with the intervention of National Consumer Disputes Redressal Commission (NCDRC), New Delhi. But, it all depends on the discretion of NCDRC. All the transfer cases are handled by Court No.1 of NCDRC presided by the President himself.
Recently, I got my case filed in Gautam Budh Nagar Dist. Forum in U.P. to the New Delhi Dist. Forum, I.P. Estate, New Delhi against Realtor--'Gardenia Shelters Pvt. Ltd., Noida' with the approval of NCDRC on medical grounds.
