Drugs Act

I wonder why our local circle members are not aware that there is already a specific section in drugs Act which applies to all chemists "To dispense with only the prescribed quantity of drug ( As written by the Doctor)".All over India, this is followed and people are getting the prescribed quantity even if the chemist has to cut the strip. Only in the City of Mumbai, this law is defied by chemists , because they have a strong Chemist- drug dealer association. Further, in Mumbai most of the moneyed people do not bother ,but it pinches the pocket of the poor who are not aware where and how to complain. This Consumer Association has passed on numerous such complaints ,including of the reputed hospital pharmacies to the area Drug Commissioner ,who punished such delinquent chemists/pharmacies by suspending their licences ranging from four days to one month.
What you need in complaint is to give a copy of prescription and copy of cash memo of the pharmacy who sold more quantity than what was prescribed.

Having said this, I feel any cartelisation by the Chemists or their associatin must be curbed by enacting/amending the law to make such practices illegal and punishable with stiff fines or even imprisonmentand de-recognition of such Associations. more

We are good at drafting law but very poor in execution. more  
In fact respective state governments are responsible to ensure implementation and compliance of every clause of laws & rules by all sections of the society and the business community, which is not done at all to get political mileage. Extreme permissiveness of these governments promotes monopoly and high-handedness as well as lawlessness among different sections of the society always targeting the common man and making them sufferers. Moreover, we consumers do not have a strong platform to fight against all such odds at our own forcing the administration to act against all law evaders. more  
Mr Mohan, right you are. Since the Drugs & Cosmetics Act also provides such strictures in the interest of the general people to prevent misuse or overuse of drugs. more  
In Bangalore many chemists give the exact quantity as prescribed. However, I also faced this problems sometimes. But we need to remember giving exact quantity will not be possible for certain medicines (tablets/capsules) which are sold in sealed bottles with a standard quantity as often there is a humidity suppressor inside the seal. more

No. This issue has been well represented and discussed in the past, but it is the bureaucracy that does not move to implement the law. Chemists are not willing to dispense medicines in units as prescribed by the doctors as it is practically not possible for them to build up inventory of the broken strips of medicines supplied by the manufacturers. If you have a solution that is economical for the manufacturer, distributor, and retailers (chemists), please do come out with. Chemists have a genuine issue. more

It is not the actual issue of the chemists but mainly of the manufacturers through Chemists Associations for their vested interests.

Having short of hands, they are very much active on the pharmacist issue. more  
Existence and practice existing in rural areas, by un-licensed medical stores is another additional issue linked to the inefficient state officers of the drug controller. They say they are short of hands to visit every nook and corner of the state for un-licensed medical stores, which they know and purposely avoid. more
