if we order some food through some of these apps/websites and food poisoning occurs and its proven that food was contaminated/stale, who takes the liability, food producer or the ecommerce app.

Bringing Ready to eat food under FSSAI has its own pitfalls. The regulation mechanism is certain to be overloaded and ineffective. The 'food-app' types in fact comes with its own remedies. Most of these depend on social media circles for pushing their wares and publicising their shortcomings by way of critical reviews can harm them much more than FSSAI through legal action. more
Its better and safe to refrain from purchasing foods through any eCommerce site. If we are at all interested to have a change of test, is it not better to visit a local reputed restaurant and enjoy foods of our own choice? more
I am sure the E-Comm site builds in safeguards into its contracts and terms and conditions with both the manufacturer and the customer that they are not responsible for any food poisoning. I do not know what the law is in this regard. But the App or the E-Comm site is technically only a distributor/agent for the food manufacturer. Hence according to me the lability falls on the manufacturer who cannot shirk his responsibility. It is the responsibility of the manufacturer to ensure that the delivery process of the E-comm site are such that the food reaches in the intended condition to the customer. The manufacturer cannot pass on this responsibility to the E-Comm site. more
Every E commerce sites dealing with Food has to get mandatory registration with FSSAI and they are fully liable as they are the sellers and service providers. If it is E-market place, then they are exempted from any liabilities.
