Dear Chandra Kant and Shyam Sundar Joshi E-Way Bill is required when the value of consignemnt is more than Fifty Thousand and is transported through any motorised vehicle. In this case the consignment from your premises is carried away by hand so no motorised vehice is involved irrespective of teh fact that where he is carrying the goods. The main thing is that you have delivered the goods by hand at your business premises so no need to generate any E-Way Bill in this transaction or any other such transactions. The all surmises that he will travel by road or by rail or by any other mode of transport through motorised vehicle are baseless as the main thing is that at what place delivery has been given and what's the mode of delivery? Here delivery has been given at business place and mode of delivery is by hand. If we go on to consider mode of travelling of a person then in each and every case of more than fifty thousand value E-Way Bill would be compulsoriy which is not the intention of the legislature. more
At Airports and Railways the Tax Authorities check the documents like invoice not E-way Bill as they know that the goods are being delivered by hand and the purchaser is taking the goods at his or her own. Moreover if you book any goods for transportation through Air or by Rail in that case you have to generate E-way bill at th etime of taking delivery from Air Port or railways not at the time of booking. Tax Authorities can penalise if you don't have proper purchase invoice with goods and goods are of significant value. more
But there are checking at the airport/railway by the tax authorities and they penalise if you dont have required documents !! (though Invoice is carried with goods) more
Yes it is required as he is carrying the materials with him but he will not be moving to Mumbai from Noida by foot only or by any other Non Motorized Carriage. He must be reaching Mumbai with some vehicle. So Way Bill has to be prepared using the Vehicle No. more
Pl answer GST experts to the genuine question put across, we too face sometime this kind of issues which nobody can answer or few questions are answerless !! more
