File case pleading GST only for amount received

The government says that GST should be paid before 20th of every month against the invoice raised, irrespective of the payment against the invoice received or not.

I think this is totally unjustified as no one can be asked to pay tax for an amount not received or earned.

I want to file a legal case pleading that the government should change the rule that GST should be paid only against the amount received and not against the invoice for the amount raised.

I want advice as to whether I have a sound case for seeking justice from the court on the above point.

You have no case against this as Excise Duty and VAT were always payable whether payment has been received or not. more

Tax payment of the supplier will not depend on the payment by the recipient against the supply and it never happened earlier i.e. in VAT regime & so on. There is no wrong or illegality to charge tax and to pay the same within the stipulated date by the supplier. But for the first time in indirect tax history an important provision has been introduced in section 16(2) of CGST Act where it is clearly mentioned that if a recipient fails to pay the supplier within a period of 180 days, then an amount equal to the ITC availed by the recipient shall be added to his output tax liability along with interest. This is no doubt a remarkable step taken by the GST council. more

Sir, Other existing taxes like commercial tax also we paid irrespective of payment received from customer/debtors. In my opinion, 1% or 2% tax in turnover & no input, it is easy for all. more
