Fraud - Property related by dealer
I have given x amount of money to a property dealer as he approached me to help buy a property from Omaxe. As the dealer was known i trusted him with my money given as advance booking. Its been close to two years chasing him to settle amicably though all he had submitted to Omaxe is a mere 25% of the advance given to him. He has defaulted, cheated and wrongly represented facts\transactions. Now at the fag end of my patience would like to seek advice how to get a legal - Criminal and Civil case logged against him especially with what all sections.

Criminal, Civil, Consumer Forum are some of he alternatives, including RERA, SEBI and others. Out of above, Criminal and Consumer preferred due to very reason of time, money and efforts. Lodge police complaint against all concerns, Builders, Broker and others who participated. If the Police is unable to register the Crime then U/s 154 /156 (3) to the nearest Megistrate / JMFC. Simultaneously, lodge complaint with Consumer Forum if the total amount is less than Rs. 20 Lacs, if above Rs. 20 Lacs then to the State Consumer Commission (Mumbai) or concerned State capital Or where ever the circuit bench is available. It is not only cheating, but also as Investor, Depositor and other relevant provisions of Law. more

Cheating seems to be a norm. People in posh colonies can squat upon at disputed places without approval of corporations. They give a Damn to maps and Completion Certificate of buildings. Fight a legal case of cheating if you are supported by evidence of being cheated more

Thanks a lot everyone for your guidance and revert it was really a boon. Now the plight is to find good references in legal and police for going ahead with both criminal and civil cases. Any reference in around Gurgaon please do mention it would be really a much needed help. more

thanks alot for the suggestion. fortunately, the payment was done with cheque though my bad that because of the influence it was in dealer name than builder Omaxe. Also I kept patience over the years and have the trial of our messages with the dealer. Additionally I do have the Omaxe allotment letter now from Omaxe. Even dealer has paid 25% of the advance given to Omaxe as well. Fight is for the 75% leaving out the loss of interest and agony faced.
Let me explore option unfortunately not very comfortable reaching out to legal as well as police expert of finding right guidance. If any reference in Gurgaon please do mention! This would be more of criminal case than consumer court .... and than obviously civic to get recovery of any kind.... more

Dear Anoop Singh -- I understand your situation. Money and Power always corrupts even with our own kith and kin, what to talk of a stranger even trusted! Going to Consumer Court is a very nice suggestion; going to Police and file an FIR is another good suggestion. If you have some documentary evidence of having given him money for the given purpose, I would suggest meeting a good Criminal Lawyer (known and helpful to understand you personally) and File a Criminal Suit to nab the culprit with a non bailable arrest warrant. I do have email as well as sms trail of communication with the dealer .... also payment was thru cheque .... I agree not very comfortable that police will be of assistance if I am not prepared with actions to seek .... more

If you have any single document you can proceed against him with the help of an advocate. If not it will be difficult. Taking police help may not be fruitful. Even if you have a letter or any mode of communication either at the time of giving the amount or afterward is enough to proceed against the dealer more
