Recently the Supreme Court of India has delivered a judgement prohibiting vacation of tenants by Banks from the properties offered as collateral securities. Despite the Banks are getting the tenants vacated from the premises of the properties and taking possession of the properties forcibly, which is violation of the judgement. The SC was of the opinion and was pleased to observe that SARFEASI Act, cannot over ride other laws. In other words the banks acting under the said act cannot summarily seek eviction of the tenants with out following dueprocess of law.
